This chapter surveys forms of status by which legal systems assign rights, obligations and capacities to various categories of person. Though such discussions have tended to restrict themselves to statuses recognized in Roman law (the hierarchical birth-based statuses that Maine contrasted with the contractualism of later Western systems), cross-cultural comparison requires a wider lens. Hence, the chapter covers status within the polity, official or military status, unfree or servile status, putatively ‘natural’ statuses, status in the family and status as member of a voluntary or professional association. Special attention is given to the mechanisms involved in change of status, and to status as a factor in legal penalties. It is proposed that, in systems of religious law (which often operate parallel to civil law in a legal-pluralist context and across borders), status within the ‘ecclesial’ polity is comparable to civil status (citizen, resident alien, etc.) within a territorially defined polity.

The ‘noble lie’ is crucial within the political philosophy of the Republic, as the ideology of the charter myth needed to motivate the citizens of the Republic’s good city in general, and the rulers in particular, to care above all for its well-being. I look first at the way lying figured in the Greeks’ imaginary and their political discourse, particularly that of the Athenian democracy; then at ethical dimensions of Socrates’ notion of ‘useful lie’, and his distinction between deception by speech and deception in the soul. What makes the ‘noble lie’ useful is its ability (if believed) to instil in citizens love for their community (not merely calculation that promotion of its well-being is in their own self-interest), through representation of their human identity as membership of a single family, with their core affections and obligations directed to their mother country. It is that sense of basic identity and commensurate obligation, not dialectically based grasp of eternal truth, which will persuade philosophers to take their part in ruling the city. Finally, I tackle the issue – its difficulty highlighted by Socrates himself – of how belief in the narrative is to be secured.

In keeping with Jessup’s project of constructively contesting legal doctrinal understandings of law, this chapter analyses the Situation Room Photograph to illustrate transnational law as drama. The metaphor of law as drama inheres in Jessup’s text. Yoking Jessup’s turn to drama with anthropologist Victor Turner’s notion of social drama, this chapter shows how, as a text of transnational law, the Situation Room photograph illuminates the normalizing and legitimizing of the national security state, even as gestures and representations of law associated with liberal democracy thread through the image.

Red: Racism and the American Indian: explores how racism works in American history and American law. In the nineteenth century American Indians were targeted not for their labor but for control of their land and resources. Berger suggests the different origins of racism have manifested in a modern movement to make Indians ‘equal’ that is really a twenty-first-century attempt to treat tribes as racial groups instead of recognizing them as sovereign entities.

The technical aspects of printing and distribution remained largely unchanged in the 1790s, but censorship controls and copyright became more complex and unpredictable. The failure of political leadership in France naturally encouraged extensive discussion throughout the rest of Europe, with a wide-ranging exploration in print of an array of political themes: the nature of civil government, national identity, democracy, popular political participation, voting, formal constitutions, law reform, and other contentious issues. Women saw unprecedented opportunities in Paris, but their efforts to gain political influence were largely thwarted. Strong popular political participation exposed deep ambiguities which were reflected in print. A comparison of political debate in London and Paris with other parts of Europe suggests that authors, publishers and readers all suffered restrictions, but such factors were both asynchronous across different cities and closely contingent on local political circumstances. Disagreements over the need for repressive control of print were not resolved in the 1790s.

The Epilogue/Conclusion explores some of the contemporary outcomes flowing from the mid-twentieth century developments investigated in Boundaries of Belonging, before providing a summary of the main arguments presented in this study.

This chapter offers a new overview of the Scottish Enlightenment political theory, deploying both classic and recent scholarship to delineate its canon, scope, major concerns, inner tensions and European contexts. Emphasis is placed on the major Scottish thinkers David Hume, Adam Smith, Adam Ferguson and others – who developed a profoundly novel vision of political thought itself as a vital political and moral act, and hence of their own historical agency. The chapter juxtaposes Scotland s historical uniqueness, its rich sources of inspiration, and its pioneering vantage points on modern society, economy and human autonomy. It traces the tensions between statehood and citizenship, law and civic alertness, commerce and virtue, unintended consequences and affective human volition. It is argued that, while mostly moderate in political temperament, the Scottish Enlightenment thus helped revolutionize political theory as well as practice.

Are we observing a paradigm shift in public perception of world trade or just temporary shifts in public support for the global economic order that oscillate around a more or less steady level? This chapter provides an overview of the major determinants of support for or opposition against PTAs and discusses how much room to maneuver policy makers have in designing such agreements. Furthermore, we discuss what policy makers can do to increase support for such agreements. We thereby focus on framing strategies and provide an analysis of which types of arguments are conducive to increase support for PTAs and how individuals process such information. This allows us to construct different future scenarios for policy makers to better align the negotiation and design of future trade agreements with the demand of their constituencies.

Chapter 2 traces the ways in which Stevens explores the autonomy and social function of poetry by constructing built environments and architectural archetypes. It discusses a wide range of poems from Ideas of Order and The Man with the Blue Guitar to highlight how Stevens engages in issues of poetry’s autonomy and its social function by means of making up places for poetry. His spatial formations operate with an impulse to project an independent aesthetic territory. Far from an instance of aesthetic indifference, the impulse to demarcate a separate space is motivated by a desire to envisage new forms of engagement with the period’s unsettling cultural and sociopolitical circumstances. The chapter teases out these forms of engagement in Stevens’ approach to the cultural debates over a “usable past,” his exploration of citizen-state relationship, his treatment of the poet’s fláneuresque connection to the city, and his vision of poetry’s relation to community.
