  • Summary

    Chapter 2 explores the structure and evolution of federal, state, and international SORN policies. The chapter first outlines the history of federal legislation in the United States that has shaped the current SORN environment, beginning with the 1994 Jacob Wetterling Act and continuing through the 2006 Sex Offender Registration and Notification Act (SORNA) and its subsequent amendments. The chapter then explores the key points of variation in state SORN policies, underscoring the elusive nature of fulfilling SORNA’s vision of a uniform national system. This analysis examines two particularly prominent points of interstate variation: provisions for the registration of juveniles and mechanisms for registrant classification. The chapter concludes with a brief examination of SORN systems outside the United States, indicating that, although many countries have adopted provisions for requiring registration with law enforcement, the provision of public access to registrant information is far less common.

  • Summary

    Given the magnitude of juvenile sexual offenses and the toll they take on society, it is surprising they were not consistently taken seriously until at least the 1970s. As it is evident from the material presented in this chapter, perhaps the most overarching principle pertaining to juvenile sex offenders is that they are a heterogeneous population. Having said this, they do share some commonalties. A number of sex offender categorization schemes are described. The chapter presents different types of juvenile sex offenders along with selected case vignettes. The two primary physiological assessments used in sex offenders are phallometry and polygraphy. Different sexual offender pathways are an interesting concept to consider when looking at risk of recidivism. Becker and Kaplan described three paths the juvenile sex offender takes: dead-end, delinquency, and sexual interest paths. For most sex offenders a "cure" is not realistic, and instead, an ongoing management strategy is required.

  • Characteristics of adolescents who sexually offend, their patterns of their offending behaviour and the defining features of their victims are firmly established in the overseas literature. The research literature in Australia, however, is less developed. This study describes the characteristics of a sample of clients of the Sex Offender Program of the New South Wales Department of Juvenile Justice and examines patterns of offence behaviours and related descriptions of victims. Adolescents who sexually offend in NSW have backgrounds of low educational attainment and abuse and a range of other social risk factors, and they are most likely to victimise female children. A typology of adolescent sex offenders based on their offending behaviour is offered.
