Law is a powerful commitment device. By entering into a binding contract, a contracting party can invoke the coercive law enforcement powers of states to compel another party to perform. Many, if not most, contracts are carried out without ever invoking these coercive powers; they operate in the shadow of the law. Less attention has been paid to the flip side of law’s shadow: the possibility of relaxing or suspending the full force of the law, or making law elastic. While this may seem anathema to the “rule of law”, it is not an infrequent occurrence, especially in times of crisis. The elasticity of law should be distinguished from the incompleteness of law, that is, the inherent limitation lawmakers face in trying to anticipate all future contingencies. In this paper I will offer two tales of the American Insurance Group (AIG) to illustrate the elasticity of contracts as well as of law.

Qu’avons nous appris de l’architecture fonctionnelle des processus de prise de décision dans le cerveau humain grâce aux neurosciences computationnelles ? Dans un premier temps, nous verrons comment les modèles de diffusion ont permis de proposer des algorithmes de décision capable d’expliquer les relations complexes entre proportion de choix et temps de décision observés lors de décision simple, et de faire des prédictions testables sur l’activité cérébrale des régions impliquées dans ces processus cognitifs. En prenant l’exemple de choix économiques simples, nous illustrerons l’intérêt de ce cadre mathématique pour comprendre comment différentes régions cérébrales peuvent interagir pour produire des décisions reflétant nos préférences subjectives. Finalement, nous discuterons autour d’un modèle mathématique capable de détecter les changements d’environnements pour interrompre les tâches en cours et déclencher des phases actives d’exploration afin d’illustrer la façon dont les modèles computationnels permettent de détecter des transitions brutales dans les stratégies comportementales et de prédire avec précision l’activité cérébrale dans le cortex préfrontal humain. Nous conclurons sur l’importance du cadre théorique de l’inférence Bayesienne et, en particulier, des notions de confiance et d’incertitude pour caractériser les algorithmes utilisés par le cerveau humain pour choisir.

A benchmark is organised to quantify the variability relative to structure dynamicscomputations. The chosen demonstrator is a pump in service in thermal central units, whichis an engineered system with not well-known parameters, considered in its workenvironment. The blind modal characterisation of the separate pump components shows a5%–12% variability on eigenfrequency values and a less than 15% frequency error incomparison with experimental values. The numerical-experimental MAC numbers reach 0.7 atthe maximum, even after updating. An example of modal results on the pump assembly fixedis presented, which shows a larger discrepancy with measurement values, essentially due tothe modelling of the interfaces and boundary condition, and to the possible simplificationof the main components F.E. models to reduce their size. Though a significant frequencyerror, the first overall modes are correctly identified. If this tendency can be confirmedfrom all the participants’ results, the conclusion to be drawn is that, if the predictivecapability of F.E. models to represent the dynamical behaviour of sub-structures issatisfactory, the one relative to structures that are built-up of several components doesnot allow their confident use. Additional information issued from measurements is neededto improve their accuracy.

On compare deux cas d'incertitude qui ont abouti à des arguments de référence en faveur de moins d'activisme de la politique monétaire : celui où l'incertitude porte sur l'effet global de la politique, comme dans Brainard (1967) ; et celui où elle porte sur ses délais d'action, comme dans Friedman (1960). On montre que l'approche bayésienne donne des résultats similaires dans les deux cas, mais que ce n'est qu'avec une incertitude sur les délais d'action qu'une approche en termes de robustesse (critère du minimax) conduit nécessairement à moins d'activisme. De plus, dans ce cas, l'activisme de la politique robuste est encore plus faible que ce que donne l'approche bayésienne.

Cet article présente un modèle dans lequel un individu représentatif consomme une unique ressource environnementale, que l'on suppose renouvelable. Nous supposons, par ailleurs, qu'il existe un ensemble de phénomènes naturels aléatoires susceptibles d'affecter le stock de ressource disponible pour la consommation. Nous analysons à l'aide de ce modèle les comportements de consommation face à une incertitude sur la disponibilité d'une ressource environnementale dans le futur. Notre objectif étant de dépasser les résultats, somme toute triviaux, qui font l'essentiel de la littérature sur la décision en incertitude, et qui consistent à remarquer qu'en présence d'incertitude, l'agent adopte généralement un comportement plus prudent quant à son usage de l'environnement que dans le cas où l'incertitude n'existerait pas.

Nous montrons d'une part comment la prise en compte successive des contraintes physiques, de disponibilité de la ressource et de solvabilité (ou de survie), auxquelles font face les consommateurs, modifie fondamentalement leur comportement, relativement à l'hypothèse de cycle de vie. Et, d'autre part pourquoi leur omission, ce qui est généralement le cas dans la littérature, peut amener à des conclusions éronées.

This paper investigates empirically the influence of uncertainty on corporate investment. Uncertainty of demand, output prices and investment prices are measured by the standard deviation of (pre-)filtered Belgian (1984-1992) and Spanish (1983-1993) panel data, and included as explanatory variables in the investment equations derived from a neo-classical model with financial constraints. GMM-results indicate that investment behaviour towards output price uncertainty differs significantly in conjecture with a firm’s size and leverage.

Fisheries can be characterized as a network of interactions between natural and social systems, and thus should be viewed as complex, dynamic systems. Due to the multiplicity of components and processes, the involvement of various disciplines is required to understand the inter-relationships within and between the systems, and more so to adequately address management issues that typically affect several elements in the systems. To be successful, multidisciplinary approaches require mutual understanding of the perspectives, concepts, vocabulary and methods held by various disciplines, and agreement on the objects to be studied in common. In that spirit, at framework is suggested whereby fisheries systems are decomposed into related sub-systems that can be recognized by both Social and Life Sciences. Some key concepts attached to cach module and to its interactions with the others are identified, and may be starting points for dialogue and common undertakings by various disciplines, with a view to improving our understanding of the dynamics of the whole system.
