Whereas before this time, at Peel Town, the eighteenth day of July 1643, before the right honourable James, earl of Derby, lord of the said isle, etc., the officers spiritual and temporal, with the twenty-four keys of the said island, and four men of every parish, were assembled together to advise and consider of certain grievances of the church and commons of the said isle, laid down and expressed in and by their several petitions and complaints unto his lordship, and to study and devise such convenient remedy and redress therein as might or may best stand with the maintenance and preservation of his lordship's royalties, rights and prerogatives of and within the said island, the good and welfare of the church and commons of the same, and the peace and safety of the whole state in general; at which place and day it was mutually condescended and agreed unto by all parties, as well complainants as defendants, and it was their humble desires, that his lordship should chancelarize, order and decide all and every their matters of business and complaint or aggrievance whatsoever, as in his honour's wisdom shall be thought meet and convenient. To which order, doom and decree every of them, viz., the reverend father in God Richard, lord bishop of this isle, with his officers spiritual and the body of the clergy, the said twenty-four keys of the island, with the four men of every parish, in the name of themselves and of the whole commons of the isle, by whom they were chosen and thither sent for that purpose, did condescend and agree for them, their heirs and successors, to stand, to perform, and abide such his lordship's order, doom and decree therein, as should be thereafter published and declared under his honour's hand and seal.

Reverend sir, We the archdeacon and clergy of the isle and diocese of Man this day assembled beg leave to return our most grateful thanks and sincere acknowledgments for that fresh token of your benevolent regard and esteem for this your native country, signified to us in your letter of 1 Oth January last to the reverend vicar-general Wilks, of adding 200 pounds more to the fund already established, chiefly by your most worthy father and yourself, towards the support of the poor clergymen's widows and orphans of this diocese, a fund though not very extensive in itself, yet has been the means of alleviating that extremity of distress they otherwise would have been unavoidably exposed to.

With you, sir, we are unanimously of opinion that the vesting the whole of this fund in the purchase of a landed estate within this island would, for many obvious reasons, be more eligible than suffering it to remain in any of the public funds, which are often of a fluctuating nature and beyond our comprehension. We have severally in our respective parishes made a strict inquiry for a proper purchase, and as yet are not able to find any we would recommend, and we shall continue to give every aid in our power to this desirable work. But should it so happen that a landed estate cannot be obtained, we would as the next most desirable purchase recommend some portion of the impropriate tithes, if approved of by you and by council learned in the law, as to the sufficiency of the title, hoping their graces of Atholl may be tender in their terms, as [284] such purchase is meant for a charitable purpose.

As to the fixing proper trustees and the qualifications of the recipients, we beg leave to refer those points to your own prudent consideration, who are already so well acquainted with the nature of this fund.

• 1. We order and decree that the archdeacon, officials or registrars shall have nothing to do with our fifteen episcopal causes above written, but only to act in such things as are proper and belonging to their jurisdiction for the half year, and keep records for them by themselves.

• 2. That our vicars-general shall have no power to make substitutes under them, but to act, and execute all things belonging to their place and office in their own persons, and to keep records of all their proceedings on their registry.

• 3. That our vicars-general shall not order, censure or decree any matter or cause ecclesiastical severally, but jointly and unanimously to keep sheading courts as formerly, and a monthly court for hearing and determining matters of difference and controversy in the convenients [sic] place that they shall think meet.

• 4. That our vicars-general shall not order or censure causes contrary to our statutes, and spiritual written laws, though there be some precedents otherwise, notwithstanding the statute[s] in such cases are to be observed until the ordinary's pleasure be further known touching the said statutes.

• 5. That all the ministers within this isle liable to our spiritual jurisdiction shall be careful and diligent in their places and callings, and be sober, and give good example in their lives and conversations, be obedient to observe all our directions formerly given touching the worship and service of God, obedience to the canons and laws of our church,235 and if any offend herein he is immediately to be censured and punished according to the heinousness of the facts.

• 6. That no wills or decrees be proved or made but in a sheading court with inventories, and pledges written on whole sheets of paper, except it be in some cases of necessity and not otherwise.

• 7. That our registrar shall keep the court books in good order and give in all offenders’ names presented to the court to be censured, to call in for certificate under every minister's hand touching the performance of their several censures into our records, that all fines may be given in to us to mitigate, and then return to the controllers to be recorded for the lord's prerogative.

Reverend gentlemen, I am directed by the right reverend the lord bishop to inform you that his lordship purposes (God willing) to hold a convocation in the schoolhouse in the parish of Kirk Michael upon Thursday in Whitsun week next, where you are required to convene by eleven o'clock in the forenoon of the same day, if not prevented by indisposition or some other sufficient cause, and to bring along with you as usual, copies of your parochial registers of marriages, baptisms and burials attested by yourselves and churchwardens, and commencing from your last returns made of your respective registers. And his lordship also desires that if any of you have any business to be transacted or any matter or thing to be proposed, discussed or resolved upon in said convocation, that he will expect to be made acquainted therewith in writing at least one week before, otherwise his lordship must be excused from attending thereto. Sir, having received commission and special injunction from our reverend ordinary to call a convocation of the clergy of the isle, with all convenient expedition, you are therefore hereby desired to give personal summons to the whole clergy of this island particularly to make their personal appearance at Kirk Michael church, upon Wednesday next, being the seventh instant, to consult matters of great importance, which then and there shall be imparted unto them, and if any of them fail to answer this summons (which you are to give in his lordship's name, and by virtue of his authority) they must expect to be severely proceeded against for such their contumacy, as his lordship shall find just cause. Your own effectual execution hereof, and your appearance the same day with certificate of the discharge of your office herein, and the return of this our order, is also desired and expected, that the same may be recorded for our discharge in this behalf. At a convocation of the clergy at Bishopscourt, the 21 [st] day of October 1680, there appeared:

Memorandum.

This twenty-first day of October 1680, the clergy of the Isle of Man were convened by Henry, lord bishop of Man, to consult with the said bishop about the discovery and distribution of the king's augmentation and the monies due out of the impropriations, ever since the first purchase of them in 1664, and because Mr Samuel Wattleworth and Mr Thomas Robinson are pretty well acquainted with the concerns thereof, and are not far distant from the officers with whom they are to negotiate this affair, therefore the said clergy, with the consent of the said bishop, have unanimously elected them two to solicit this business and to report their proceedings every twenty-first day of the month till this affair be brought to a good conclusion, and for their pains have agreed they shall be recompensed at the discretion of the said bishop out of the said monies, when it is received. As witness our hands hereunto subscribed, the day and year above written.

1. Of prescription and tithe exempt

All demesne chattels in the demesnes [and] granges which abbeys keep for their own provisions and glebe, are not tithable.

No customs can prevail for tithing for other farmers.

A prescription if it be just, of time out of mind, without interruption or alteration, bonae fidei, it must prevail.

The statute law of England is no rule to direct us in judgment here, except such as the lord and the whole body of the island hath received for laws. For if so, then things of greatest importance for the inheritor were altered. At the suppression, men to whom the statute did pertain and knew of it must have been put to prove time out of mind after the suppression, but now to put them to prove it, which they had no cause to take knowledge of it, is an impossibility in my opinion. 2. Of the fifteen episcopal causes

Episcopal causes merely belonging to the ordinary's jurisdiction to be censured, being fifteen in number, exempt from the archdeacon's jurisdiction by ancient laws of this isle as anciently the vicars-general have received them from one another, from time to time, to be preserved, and now set down by William Norris, vicargeneral.

• 1. The censuring of any of the clergy for any default.

• 2. Adultery.

• 3. Excommunication against any offender.

• 4. Mitigation of fines.

• 5. All licences of marriages.

• 6. All divorcements betwixt married couples.

• 7. The granting of administration and the punishment of adultery.

• 8. Incestuous persons.

• 9. Witchcraft.

• 10. The calling a man a dog or a woman a bitch.

• 11. The censuring of fornication upon relapse and the second or third time; also all other offenders upon relapse.

• 12. The effusion of blood in church or in churchyard.

• 13. Profanation of the Sabbath or holy days.

• 14. The censuring of parties for not receiving the communion in or at their parish church, upon any contempt.

• 15. The committing of any offender into Saint German's prison, it being the lord bishop's own prison.

3. Children taking away their parents’ goods

Following the development of the convocation controversy in England, attempts were made by the high church party there to appeal to the example of the Irish convocation in support of their claims for the autonomy of the lower house. This in tun sparked off a debate in Ireland,, in the course of which the following tracts were published.

1. [Francis Atterbury], Some proceedings of the convocation A. D. 1705. Faithfully represented. To which is prefixed an account of the several ineffectual attempts at divers times made by the lower clergy, towards quieting all disputes, and proceeding upon synodical business. London, 1708.

This work was the immediate cause of the Irish controversy because it contained the speech made by William Perceval and Francis Higgins to the lower house of the Canterbury convocation on 4 February 1706 (pp. 26-9). In a note before the preface, the (anonymous) author writes:

To the most reverent, right reverend and reverend, the members of the convocation of Ireland. The following papers do, among other things, contain several matters of fact which relate to the present synodical constitutions of your church. The publisher of them thinks he can take no better way to satisfy his readers of the truth and justness of those representations, that by appealing to the testimony of your venerable body.

He, moreover, apprehends that the consequences of that dispute, to which they refer, may, in the event, affect the Church of Ireland no less than that of England. As the restoration of your legal synods (sitting equal[ly] by the parliamentary and provincial writs) soon followed the revival of ours, so may it justly e presumed that the fate of these several assemblies will hereafter be the same; and that their authority, reputation and privileges, declining in the one, will, in due time, proportionately sink also in the other kingdom. He therefore equally prays for the prosperity of both these assemblies, and after doing what in him lies to promote it, cheerfully leaves the issue of the cause to divine providence.
