Extract

As the Anglo-Spanish dispute which developed between 1756 and 1761 over the taking of Spanish ships by British privateers was undoubtedly one of the chief causes of the declaration of war by King Charles III in 1761, the Spanish story of these events is of considerable interest. A full treatment of the whole problem of the prizing of neutral ships has been promised by Mr Richard Pares, but the present study may be of some interest as showing the Spanish views of the situation as shown in the correspondence between the Spanish Chief Minister, General Richard Wall, and the Spanish chargé d'affaires in England, Don Felix Abreu.

Ing.; leg. 6936. Also eleven others molested in America during 1756, of which details were sent to Abreu by Wall in a letter of 13 Aug. 1757. Spain, Madrid; A.H.N.; P.deE. Ing.; leg. 4275.

79 Abreu to Wall, 31 March 1758, contained papers about ten Spanish prizes; of these S. Antonio y Animas. Both ship and cargo had been declared good prize…the Captain had had no Spanish passport. His story was that he had had one but it had blown overboard, but when he was shown a Spanish passport, he had denied ever having had such a paper.

La Esperanza. The Captain had written to a friend of his in London to say that his crew had been bribed and had told all they knew about the ships, so that he thought he was ruined. Even the Spanish authorities had thought this case suspicious.

S. Joseph. Appeal before the Privy Council was pending. Doctors Commons had asked for further proof that Captain Adams really owned the ship; when these were produced the ship and goods were released, although the saltpetre was confiscated since S. Sebastian was the backdoor to France.

Jesus Maria y Josef. Appeal before the Privy Council was still pending. Doctors Commons had condemned th e saltpetre as contraband, and made the Captain pay costs.

S. Juan Bautista y Animas. Appeal was pending. Doctors Commons had declared the cargo good prize, but restored the ship.

S. Juan Bautista. The Judge had demanded further proofs of ownership, since the deed of sale did not tally with the facts.

Na. Sa. del Carmen y San Antonio. Appeal pending.

Na. Sa. del Rosario. Appeal pending.

Na. Sa. de los Dolores. Appeal pending, because Doctors Commons condemned the cargo though the ship was restored.

Sa. Rosa. Appeal pending. Doctors Commons condemned the ship as good prize, because it was not Spanish.
