    The epilogue recounts how abolition failed in southern courtrooms, often in areas of private law that did not always – or even often – involve a freedperson. It looks ahead and argues for reparative abolition, which requires that reparations be paid for the harms produced by the aftereffects of slavery and racism and that we scour the American legal system for vestiges of slavery – those that are obvious and those that masquerade as race neutral.

    By the end of the nineteenth century, the Civil War and Reconstruction had become sites of significant narrative contests that were carried out in scores of novels and in hundreds of stories published in popular magazines. These writings are arguably central to any understanding of American literary history but usually are represented by only a few canonical Civil War novels, such as Stephen Crane’s Red Badge of Courage (1895), Thomas Nelson Page’s Red Rock (1898), and Thomas Dixon Jr.’s The Clansman: A Historical Romance of the Ku Klux Klan (1905). Well before the moonlight and magnolia school of Civil War fiction exerted its death grip on the postwar literary imagination, however, an earlier contest waged that sought to set the terms of the debate. Rebecca Harding Davis, Louisa May Alcott, William Wells Brown, and Frances Ellen Watkins Harper each sought a narrative capable of accounting for the uncertainties and possibilities of this political moment. This essay traces their attempts to imagine a different future, one that broke with the nation’s history of continued abrogation of the principles laid out in the Declaration of Independence.

    A cherished common law notion is equality before the law. This notion has shaped and defined Australian laws, and is important to law’s capacity to produce justice because it requires that everyone is treated the same before the law. However, equality before the law has not produced effective social justice and equality in Australia: demographic and socio-economic indicators consistently paint a picture of broad social inequality and a growing poverty gap — rather than one of an egalitarian society in which everyone achieves the same justice.

  • Le langage du droit crée le sujet transgenre en tissant une conception légale du sexe ou genre, une conception qui a longtemps exclut les personnes trans. L’autaire propose d’analyser le langage du genre en droit québécois pour en faire ressortir deux phases conceptuelles. À travers ces deux modèles – l’un médical et l’un minoritaire – le droit québécois relate l’existence des personnes trans en premier lieu comme un moment essentiellement transitoire et liminal entre deux états d’être binaires, alors que le modèle minoritaire y voit plutôt une réalité d’exception, se définissant par son opposition au cadre social majoritaire. Ces deux visions s’enchaînent historiquement et révèlent l’évolution récente de la conception négative des personnes trans comme minorité qui ressort des avancées législatives récentes en droit québécois. L’autaire conclut que, malgré les avancées, il reste plus à faire pour réellement inclure les personnes trans comme sujets habituels de droit.

  • For those disadvantaged by bias and barriers based on socioeconomic status (SES), constitutions can provide a defense against discrimination and a foundation for greater equality in social, economic, and political life. In light of the near-global commitment to a multi-dimensional poverty reduction agenda and the increased inclusion of marginalized groups in constitution-drafting processes, this article examines how 193 constitutions address SES and how this has changed over time. The majority of constitutions guarantee equal access to primary education across SES (59%) and prohibit discrimination on this basis (58%). Fewer guarantee access to healthcare (20%), equal rights in employment (15%), eligibility for legislative office (4%), and voting rights (4%) across SES. Constitutions adopted after 1990 are considerably more likely to protect equal rights across SES than older ones. However, 25% of constitutions – including 17% of those adopted since 1990 – restrict political participation based on socioeconomic characteristics.
