What types of institutional dynamics and conditions allow constitutional resilience in the face of attempts at undermining gains in a constitutional democracy? Using Sri Lanka as a case-study, I claim that the legal complex acting in synergy with independent public institutions (the Speaker of the Parliament) and civil society can produce constitutional resilience. Synergy between the legal complex and these institutions can transform constitutional vulnerability into constitutional resilience. I argue therefore that the legal complex theory must be extended to consider the ways in which it can work in synergy with other public institutions in being resilient against attempts at rolling back gains for constitutional democracy. I argue further that synergy between the legal complex and formal and informal institutions over the short term can only result in “simple” constitutional resilience. The development of “reflexive” constitutional resilience requires long-term synergy between the legal complex and other public institutions.

This article presents a roadmap for examining the phenomenon of monarchy in Asia, which we conceive as a pluralist institution in a twofold manner. First, many monarchies discharge a wide range of roles and responsibilities ranging from the symbolic to the religious to the legal-political. These varied functions can be usefully captured under the notion of constitutional guardianship, and call for intersectional analysis. Second, it is common for monarchies to have metamorphosed from being purely endogenous institutions to becoming ones embedded in a scheme of limited, constitutional government under the influence of ideas from elsewhere. Monarchies should accordingly be viewed as a form of legal métissage, viz. a braiding of local and extraneous ideas, practices, and rules. In this sense, a law-and-society approach is more likely to reveal the nature of monarchies than a strictly legal-doctrinal approach, although some of the latter is needed to fully appreciate the former’s significance.

This Special Issue highlights the most recent socio-legal research related to the mitigation, if not the elimination, of the threat of anthropogenic disasters in Asia and beyond. The drafts of these papers were originally presented at the Presidential Session on “The Anthropocene and the Law in Asia” at the Fourth Asian Law and Society Association (ALSA) Conference held in the vibrant city of Osaka, Japan in December 2019. The timing of this particular session, the first of its kind to be held at an ALSA Conference, turned out to be somewhat prophetic, in that two anthropogenic catastrophes—the historic zoonotic pandemic and the cataclysmic wild bushfires—had just begun to strike in December in Wuhan, China and in New South Wales, Australia, respectively. The novel coronavirus pandemic would kill more than 1 million people in the following months, after infecting more than 40 million across the globe. The Australian wild bushfires killed and displaced more than 3 billion animals, becoming the worst wildfire ever recorded in the world. Since that last ALSA Conference in December 2019, multiple anthropogenic disasters have hit various regions in Asia and across the world. The papers in this Special Issue examine various impacts of anthropogenic disasters and propose innovative socio-legal strategies to mitigate them. Included are arguments for the proposal of new legal education curricula and innovative pedagogy on environmental law and the exploration of an international multidisciplinary teaching framework in reconsidering and reshaping human-centric legal education. Also proposed is the development of a robust Earth Jurisprudence based on the adoption of the Rights of Nature principles, while moving away from the Euro-American exploitive view of nature as commodified properties. Additionally proposed is the establishment of a land-based, topological jurisprudence that incorporates the nuanced narratives of indigenous voices in dealing with the threat of human-induced ecological and environmental disasters in the years ahead.

The world can no longer deny that the planet is on the verge of an Anthropocene catastrophe. As scientists from different fields and from around the globe are discussing the causes, impacts, challenges, and solutions to the arrival of this human-induced new geological time, the field of law cannot remain behind. Rights of Nature (RoN), granting legal personhood to nature and its elements such as rivers, is an emerging transnational legal framework fast gaining international traction among Euro-American legal scholars as a new tool to combat environmental destruction. Grounded in reflections derived from long-term collaborative ethnographic work among indigenous communities, this article aims to critically and empirically unpack several interrelated concerns and blind spots at this moment of the RoN snowballing effect around the globe related to claims that this new legal proposal is rooted in indigenous lifestyles and views about nature/the environment.

This paper defines constitutional ethnography as the cultural study of constitutionalism through its symbolic representations. By focusing on the materiality of constitutionalism as embodied in various state ceremonies such as ceremonies of “royal octroy” (constitution-granting ceremonies) as well as in state monuments honouring the Constitution, it strives to offer an ethnography of a polity’s constitutional identity. In this paper, I argue that in Thailand, Westernized Hindu-Buddhist state ceremonies and monuments using Westernized Hindu-Buddhist symbolism represent the Thai monarch as the ultimate law-giver holding permanent “constituent power” and therefore yielding extra-constitutional customary powers pre-existing the Constitution. This representation, in turn, informs Thai constitutional identity as defined incrementally by courts and jurists since the early twentieth century, which in turn informs present Thai constitutional interpretation. Therefore, this paper argues that the study of state ceremonies can be a useful entry point into the analysis of a “constitutional culture” shaping modes of constitutional interpretation.

Since its inception in 1957, Malaysia’s Federal Court (FC) has often been embroiled in high-profile decisions that have dramatically shaped the rule of law and constitutional practice in Malaysia. Recent political change has renewed hope that the FC can reassert its early role as an independent and impartial arbiter of political conflict. This paper investigates determinants of the FC’s behaviour since 1960. It draws on a unique data set of 102 major political cases and socio-biographic profiles of the 73 judges who voted in these cases. After describing patterns of court decisions across time and judges, we test specifically for the impact on their decisions of the 1988 judicial crisis, length of time on the bench, the terms of successive prime ministers, and judges’ personal attributes, such as religion and ethnicity. Ethnicity, appointment after 1988, and the appointing prime minister proved to be closely associated with the direction of voting. We then position the results in the context of Malaysia’s evolving constitutional democracy and discuss their implications for students of comparative judicial politics.

This paper investigates how individuals such as judges, lawyers, clients, and court staffers as well as institutions are elevating litigation costs in Bangladesh in multiple ways. It explores how the existing law and procedures as well as key institutions further promote case delay. It also examines the ways in which police departments and the prosecution contribute to elongate criminal trials and invite additional litigation costs. Empirical data collected through in-depth interviews are analyzed, drawing propositions to individuals’ contributions to delay in case-processing time and hike up litigation costs. Data analysis also assesses common people’s perceptions and expectations from the justice sector. Contemporary legal research has been critically analyzed, where needed.

The scale and urgency of the consequences of the Anthropocene for human civilization call for comprehensive responses from human societies. As leaders in law, law schools have a role in helping their respective societies respond to the impacts of the Anthropocene. The present analysis discusses potential approaches to help law schools in Asia integrate the Anthropocene into their legal education curricula. Drawing upon existing legal education literature regarding issues of content, teaching tools, curriculum placement, and subject status as a law topic, the analysis explores the potential issues facing law schools in the adoption of the Anthropocene as a component of learning. The analysis then addresses the particular contextual sociocultural, economic, and political circumstances likely to challenge the integration of the Anthropocene into Asian law schools. The conclusion finishes with directions for future research.

The product of an internationalized peace process, Cambodia’s 1993 Constitution restored the monarchy and endowed the Crown with a political safeguarding role that successive kings have been unable to fulfil in practice. After a brief survey of the tragic modern history of Cambodia’s monarchy, this paper outlines the formal constitutional role of the king, highlighting the central dichotomy between the provisions that promise that the king “shall reign but shall not govern” and those that provide the king a more active role as “guarantor.” The paper highlights how this fundamental ambiguity has been borne-out publicly, by focusing on a handful of specific instances in which both King Sihanouk and King Sihamoni are understood to have been strategically absent from the country to avoid signing controversial legislation. Short of providing a veto power in the legislative process, the king’s safeguarding role is shown to manifest in the symbolic denial of royal legitimacy.

The purpose of this study is to show how the Japanese government has created laws with harsher punishment since the 1990s. While a tendency toward harsher punishment is common in advanced Western countries, a similar tendency in Japan has prompted scholarly discussion on whether it can be understood through the “penal-populism” framework. However, it lacks in systematic evidence. This study presents three findings that differ from previous studies through a quantitative analysis of legislation with harsher punishment. First, while previous literature argues that the legislation increased in the latter half of the 1990s, this study shows that it peaked in the middle of the 2000s. Second, while previous literature argues that the bureaucrats of the Ministry of Justice promote the legislation, this study shows that it is caused by every ministry’s drafting Bills. Third, this study shows that it does not quantitatively avoid partisan conflicts, contrary to the prediction of the “penal-populism” theory.

This article examines the constitutional nature of the Malaysian monarchies in their social context. We discuss the evolution of the monarchies through pre-colonial, colonial, and post-colonial history, and account for their survival despite several attempts to curb their powers, including restriction of the royal assent and sovereign immunity. It is argued that the powers of the monarchies respond to their historical role and social embeddedness of the monarchies, stretching the role of the Rulers beyond the Westminster norms as set out in constitutional texts. Moving to contemporary issues, we see the assertion of the right to uphold the Constitution in relation to prime-ministerial appointments, and acting on advice. Here, the monarchies reflect a braiding of both traditional elements and Westminster constitutional norms.

It will be familiar to many that the environmental emergency of our times generates a number of difficulties for our thinking of law and society. It is argued in this essay that the languages of place-making make some sense of these predicaments. The essay proceeds through the close reading of an Extinction Rebellion protest and two landmark judgments. The protests, and their policing, are keyed to specific places and their atmospheres. A first judgment concerns the destruction of habitat and the extinction of native wildlife species; a second concerns the impact of coal mining on greenhouse gas emissions and climate change. A sense of place emerges with the aesthetic reason of judgment. The emblems and topics of legal speech, it is argued, give form and technique to the writing of place. A renewed jurisprudence of topography makes legible the meeting places of law and the environmental emergency.

This paper analyzes how illegality can be legitimized in authoritarian states by examining a contested case of transnational illegal drug brokerage in China. Triangulating news articles, legal documents, and interviews, the study distinguishes between two pathways of illegality legitimation: depoliticized and politicized. I argue that the depoliticized pathway is made possible through pragmatic, moral, and legalistic frames, whereas the politicized pathway builds upon an institutional frame. I also identify the media as essential agents of illegality legitimation. While illegal-practice participants and the legal authority tend to only mobilize depoliticized frames, the media make both depoliticized and politicized efforts. Through this in-depth analysis, the paper deepens our understanding of the social construction of illegality and the intricate relation between law, media, and society within authoritarian states.

This article describes post-colonial state-making in the absolute monarchy of Brunei. After detailing the Sultan’s powers, contextualizing the monarchy’s stability, and introducing its state ideology, Melayu Islam Beraja (“MIB”), the article addresses formal laws, such as Brunei’s Constitution and a new Islamic penal code, which are symbolically significant for the MIB state’s (self-)legitimation but have little immediate relevance to many Bruneians’ lives. The article, therefore, shifts its focus to normative spheres that receive much less scholarly attention but, arguably, should—namely state-rituals like the Sultan’s three-week-long birthday celebrations. These, and other non-legal spheres, including, also, royal speeches, contain normative aspects that reflect and impact key developments in the MIB state. Grounded in the Royal Birthday’s and Islamic penal code’s analysis, the final part problematizes stereotypes of Brunei being a “sharia state” vis-à-vis its multidirectional normative messages and ability to hybridize broad cultural influences for the ruling system’s benefit.

This article investigates the Bangladeshi garment industry that supplies ready-made garments for global brands and the corporate social responsibilities (CSRs) of the brands/multinational corporations (MNCs) towards their supply chains. Although outsourcing and global trade have boosted the living standards of many people in the Bangladeshi garment industry, there are some significant concerns regarding the working conditions and treatment of workers in these supply chains. This, in turn, cannot, and should not, be detached from the legal relationship between the Bangladeshi supply chains and the MNCs contracting with them. This article examines the impact of COVID-19, which has exposed the fragility and the pre-existing flaws in the relationship between the MNCs and their suppliers more clearly than at any other time in history. There is a huge governance gap between MNCs and supply chains that needs to be addressed urgently. This article assesses the legality of the cancellation of orders by the brands that invoked the force majeure clause. In doing so, this paper briefly deals with the responses of three American retail companies, namely Sears, Kohl’s, and the Arcadia Group, in the wake of the COVID-19 pandemic. It illustrates that the power asymmetry between the MNCs and their suppliers has put the supply chains in an unreasonably disadvantageous position, creating unfair and even unconscionable conduct by several MNCs. This article also looks at solutions for the existing problems, focusing, inter alia, on non-financial reporting requirements in the US and the EU to implement CSR in supply chains. However, disappointingly, the authors had to conclude that MNCs typically have the propensity to disregard CSR, whenever it is convenient for them and use CSR for mere “greenwashing” purposes for their strategic benefit only. It is a problem that requires constant attention and continuing research to find long-term solutions. The article employs doctrinal methodology and, by conducting a meta-analysis of literature and case-studies, it provides a comprehensive understanding of how the industry works.

This article provides a descriptive account of the evolution of the Bhutanese monarchy, and normative claims about its endurance and its nature, suggesting that the monarchy is both the expression of as well as the guardian of the country’s constitutional identity. Bhutan became a democratic constitutional monarchy by adopting the written Constitution in 2008 after a successful 100 years of hereditary monarchy. The willingness of successive monarchs to evolve based on changing times, their ability to ensure stability and continuity, and work for the benefits of the people and country guided by the principles of Buddhist kingship seem to have contributed not only in them benefitting from unqualified support of the people, but also in attaining the status of an expression of Bhutanese constitutional identity.

Although China remains the world’s most prolific death-penalty jurisdiction, it has also reportedly reduced executions in the twenty-first century. China achieved this reduction in part through the use of a nominal capital sentence called “suspended execution.” The success of suspended execution as a diversionary tool has produced calls for its introduction elsewhere. However, there has been no empirical research on suspended execution outside China. This article fills this gap by identifying neighbouring countries where suspended-execution proposals have been considered, determining why these countries considered it, and examining how proposals were structured. We identify four Asian jurisdictions—Taiwan, Japan, Vietnam, and Indonesia. We find that all of these countries looked to China for inspiration; each did so independently and for reasons unrelated to China’s death-penalty reforms. Our findings provide insights about capital punishment in Asia, the appeal of suspended execution, and the role of China in regional penal practice.

This paper analyses how the legal consciousness of Chinese enterprise managers has transformed in the face of drastic changes brought along by major events in socialist China. During the past 70 years, there have been in place a series of radical and pervasive changes in the legal framework constituted by a communist system frequented by mass political campaigns, trailed by a massive liberalized move towards a market economy. By building upon the thesis of legal-consciousness narratives suggested by Ewick and Silbey, this paper discusses how Chinese managers have evolved through various states of “With the Law,” “Against the Law,” and “Under the Law” legal consciousness. It is suggested that, in the coming era of globalization under socialist China, Chinese enterprise managers may start to embrace a new narrative of legal consciousness—“In the Law”—by participating more actively in the socialist system with Chinese characteristics.

When Japan signed the Hague Convention on the Civil Aspects of International Child Abduction, the government enacted a new act to deal with international parental child abduction according to the Convention in the same year. The Ministries of Justice and Foreign Affairs were immediately in charge of making a draft Bill. Once the government and respective ministries had instantly set up the legal and administrative procedure for dealing with international family issue under the Convention, as some studies argue, simultaneous issues of the family in separation in Japan were underdeveloped. Employing a method of content analysis of the record of policy debates by authorities, observing both diplomatic and domestic frames referred in the debate in contrast, this paper highlights this law-making process delivered and elucidated continuous consecutive inquiries about radical questions of the current Japanese family law regarding the wellbeing of the changing families and their children in contemporary Japan.
