As a consequence of the still increasing transnational commercial and scholarly cooperation and exchange, more and more often legal information has to be translated. Sometimes the content of legal documents (contracts, statutory provisions, books and articles on legal topics and so on) has to be translated into another language. But even more frequently, information on rules from one legal system has to be provided in the legal language of another legal system. In both cases the translator or the lawyer involved is confronted with difficulties of legal translation. In both cases bilingual legal dictionaries could play an important role in the translating process by providing translation suggestions and information on the linguistic context of terms in the target language, such as specific noun-verb combinations, or typical collocations.

Prior to designing strategies and information literacy programs to combat the dissemination and proliferation of fake/false news, it is instructive for legal information professionals to understand the characteristics of fake news and the context of its historical development.

South Africa suffered a long history of colonization, racial domination and land dispossession that resulted in the bulk of the agricultural land being owned by a white minority. Black people resisted being dispossessed but were defeated by the superior arms of the newcomers. As Lewin has written, “whatever minor causes there may have been for the many Bantu-European wars, the desire for land was the fundamental cause.” Despite the claims that South Africa was largely uninhabited at the time of the arrival of Europeans, documentary evidence shows that in fact the land was inhabited. Thus the journal of the first European to settle at the Cape, Jan van Riebeeck records incidents of confrontation with the indigenous Khoi-khoi (or Hottentots) in 1655.

There has been increasing dissatisfaction with the way Arctic-wide cooperation under the Arctic Council operates. Scholars and nongovernmental organizations (NGOs) have taken up the idea of finding a new direction for the work of the Council by drawing on the experience of the other pole, the Antarctic, and its well-established structures of governance. At first sight, this may seem like a misdirected idea, given that the two poles show more differences than similarities: the Arctic consists of ocean surrounded by continents, whereas the Antarctic is a continent surrounded by ocean; the Antarctic has no permanent human habitation, while the Arctic is inhabited by indigenous peoples and other local communities. Yet, the two polar areas also resemble each other in many respects. Both have extreme climatic conditions, receiving less radiation from the sun than other parts of the globe, and the ecosystems have had to adapt to very cold and dark environments with short and light-filled growing seasons. In such conditions, the ecosystems are simple, containing only a few key species, and are thus more vulnerable to human-induced pollution than those of more temperate areas.

The “Norme in Rete” (NIR) project aims at establishing standards for Italian legislation and tools to promote their adoption. In this paper an overview of these standards, including their latest version features, as well as a description of the tools developed by ITTIG-CNR for their implementation are presented.

In the past five years, we have witnessed extraordinary growth in the amount of legal scholarship, legal practice, and public policy at the intersection of law and neuroscience. For instance, in 2010 the first Daubert hearing was held on the admissibility of functional magnetic resonance imaging (fMRI) lie detection evidence; a Florida court was the first in the nation to admit quantitative encephalography (qEEG) evidence; and a Supreme Court decision on life imprisonment for minors cited brain development research. In France, the Prime Minister established the first Neuroscience and Public Policy program within the France Ministry for Social Affairs, and in the United States, multiple state legislators proposed bills related to neuroscience and law. Academics, too, have taken notice, with a number of symposia being offered around the country over the past few years.

This paper briefly outlines what copyright is, the main actors in the copyright phenomenon, and the need to maintain a balance among them. The paper further discusses the difficulty in upholding copyright in relation to access to information in the University of Ghana, problems associated with the use of digital materials, the inadequacy of the permitted use principle, and the failure of copyright legislation to address the needs of the library and other groups or institutions.

Interlibrary Loan is not a new concept. The practice of lending and borrowing materials occurred as far back as the 8th century in Western Europe. An 8th century copy of St. Augustine's De Trinitate in the Bodleian Library contains a page originally left blank at the end of the manuscript whereupon “an Anglo-Saxon hand of about the year 800 entered a small list of books.” Elias A. Lowe's translation and analysis of this list and adjacent annotations demonstrates that the list was likely a “catalog” of manuscripts in the ancient library of St. Kilian's at Würzburg, and that several books were loaned to Holzkirchen and to the monastery at Fulda. The three institutions were geographically close, with Holz church being a dependency of Fulda monastery. Fulda's library was the largest in Germany except, possibly, for St. Gall.

Many law schools have opened their doors to international students, inviting them to participate in the following types of programs: (1) LL.M. programs designed exclusively or primarily for international students, (2) LL.M. programs designed primarily for U.S.-trained lawyers and law students to which international students are admitted, (3) S.J.D. and J.S.D. degree programs to which international students are admitted, (4) J.D. programs to which international students are admitted, and (5) Intensive prelaw training programs for international students entering American law schools.

Should cultural property taken by a stronger power or nation remain with that country or should it be returned to the place where it was created? Since the 1990s this question has received growing attention from the press, the public and the international legal community. For example, prestigious institutions such as the J. Paul Getty Museum of Art in Los Angeles and the Metropolitan Museum of Art in New York have agreed to return looted or stolen artwork or antiquities. British smuggler Jonathan Tokeley-Parry was convicted and served three years in prison for his role in removing as many as 2,000 antiquities from Egypt. Getty director Marion True defended herself against charges that she knowingly bought antiquities that had been illegally excavated from Italy and Greece. New books on the issue of repatriation of art and antiquities have captured the attention of the public. A documentary based on one of these books was shown in theaters and aired on public television. The first international academic symposium on the topic was convened in New York City in January 1995.

This article discusses the responsibilities of legal scholars to make their published works openly accessible through the Internet, within the context of efforts to increase free and open access to legal information, and to improve access to scholarly literature in other disciplines. The article also considers the roles and responsibilities of the institutions that support the creation and communication of legal scholarship for improving access to legal information.

We are in an uncertain and complex period for data protection and privacy in Europe, and especially so in the UK, following the result of the ‘Brexit’ referendum on 23 June 2016. Information law, and data protection in particular, are of increasing concern for those in the business of knowledge sharing and information dissemination: media organizations, academic institutions and libraries. The notion of the ‘right to be forgotten’ is particularly troublesome, as lawyers, archivists, historians and philosophers grapple with the theoretical and practical implications. This article presents a selection of recent European and British policy and legal developments, and discusses how they are changing social practice and citizens’ engagement with information rights.

The modern Turkish state arose from remnants of ancient civilizations. The remains of these civilizations represent Anatolian history and reveal much about life in ancient times.

The World Treaty Index (WTI), first published in print form in 1974, has been a mainstay of treaty research for over a quarter of a century. A second edition was published in 1983 and a reprint of that edition appeared in 1997. Both editions of the print multi-volume set can be found in almost all major law libraries and in research institutes with an interest in international relations, area studies and globalization. The WTI lives on in electronic form and remains to this day the largest collection of treaty citations in the world, with well over 60,000 entries to date. Over the last decade, interdisciplinary scholarly research interests have increasingly focused on the kinds of information that can be extracted from The World Treaty Index.

The general frameworks within which human rights are protected in Nigeria are enshrined in the 1999 Constitution of the Federal Republic of Nigeria. Chapter IV contains an elaborate Bill of Rights. The right guaranteed include: the rights to life, the rights to personal liberty, the rights to fair hearing and the right to freedom of movement among others. Section 42 prohibits unjustifiable discrimination on basis of “ethnic group, place of origin, sex, religion or political opinion.” As for penal infractions, Nigeria has two separate codes, one applying to Southern Nigeria (Criminal Code) and one applicable to Northern Nigeria (Penal Code). These provide for offences against persons, including homicides, assaults and different kinds of sexual and gender specific violations such as rape.

Given the instant availability of information and the proliferation of questionable news, the ability to critically examine information before consuming it, is of increasing importance. The need for excellent information literacy skills is evident but lacking. This article highlights reasons as to resistance to existing information literacy efforts and suggests components for information literacy programming with a focus on fake news.

The research footprint of Information Technology (IT) in a legal system has not grown with the same pace as it has penetrated other domains. More specifically, in developing countries such as India, where the digitalization revolution is underway, the growth of legal informatics (LI) is still premature and very limited traces of IT can be observed to assist and elevate the legal system, which still functions very much in an old school way. The faster growth of population and the diminishing proportion of judicial executives and the deteriorating law and order situation along with declining human rights demand the urgent evolution of LI to grow at a very rapid pace to attain its maturity. However, the human harassments are pretty prevailing across the nation, but its intensity increases manifold when it comes to the law-enforcement agencies tasked with responsible policing, more specifically, the state police, which often operates with compromised work ethics. The situation becomes more appalling with a vulnerable population, especially women. As a result, such a population often does not muster enough courage to go to a police station to file their complaints despite acute mental and emotional pain. This is to avoid further trauma by police harassment and ergo a large number of cases go unnoticed. An underprivileged rape victim, who tries to file a report by going to a police station is a classic example of such a situation; where she is not only denied, but also gets harassed by insensitive police official(s) at the station; consequently, a good number of such victims do not go and their cases are not reported.

In this research work, we have developed a computational framework, called eLegalls, an LI-enabled innovation, as an effective solution to the above stated issues. The eLegalls system facilitates users to file their reports to police in their geographic jurisdiction, through its efficient and secure interface without any in-person visit. The eLegalls will help the vulnerable population to avoid unwanted denial and impending harassment by the police official(s) at the police station. The system is also equipped with some secure and pertinent features for the lawyers or attorneys to efficiently advocate in assigned cases. The eLegalls is envisioned to eventually be a successful legal tech, effectively serving the community.

Weaponization of state-backed, foreign investments by China is an emerging national security threat in the United States and the European Union. The U.S. and E.U. have espoused similar policy goals—to address the threat without closing their markets to foreign direct investment—while fostering increased cooperation between allied partners in screening transactions.

On the surface, the recent, China-specific measures taken by the U.S. and the investment screening framework adopted by the E.U. appear reflective of an alignment of those policy goals. Indeed, many commentators have suggested that is exactly what is happening. However, closer examination reveals a stark divergence. The U.S. has a robust screening mechanism that has evolved into a weapon of economic warfare. The E.U. meanwhile, remains a patchwork of conflicting—or nonexistent—national regulations overlaid by a comparatively toothless investment screening framework.

There is a tendency to attribute this divergence to structural differences between the United States and European Union. This in-depth comparison of U.S. and E.U. investment screening mechanisms exposes a split that goes beyond application and into actual policy. This revelation should temper expectations that the E.U. is equipping itself to block transactions that are of concern to the U.S.

Improving information literacy in law translates into developing methods for improving legal research competencies among lawyers, law students and the general public. This paper summarizes four approaches for improving legal research skills of prospective lawyers in U.S. law schools and discusses their successes and shortcomings to help assess their potential application in an international environment. These approaches include: (1) offering mandatory law school courses in legal research; (2) adding elective (or optional) credit based courses in legal research; (3) offering non-credit legal research support to law students at their point of need; and (4) testing prospective lawyers on their legal research competencies as a requirement to being licensed to practice law.
