This article attempts to situate the Office on Missing Persons (OMP) in Sri Lanka in relation to varying approaches to mechanisms for searching for the missing. In particular, the article examines the possible tensions between a humanitarian and an accountability-based mandate and supports the position of the International Committee of the Red Cross that these two approaches can in fact be complementary in nature. It goes on to contend that the OMP's mandate is primarily humanitarian rather than exclusively humanitarian, and analyzes how this distinction may impact possible criminal prosecutions. It emphasizes the importance of preserving the humanitarian character of the OMP with the objective of ensuring that the victims’ rights are at the centre of transitional justice processes.

The question of whether international humanitarian law (IHL) has an impact on how armed conflicts are conducted is a controversial one. Sceptics claim that the law is virtually irrelevant in determining State behaviour in armed conflict. Proponents point to its importance in mitigating the suffering caused by war. This paper looks at recent scholarship from historians, political scientists, economists and lawyers that challenges traditional narratives held dear by the law's sceptics and proponents alike. It then discusses implications of these approaches for a current understanding of the role of IHL in today's armed conflicts. The new perspectives allow for a broader understanding of IHL's central issues and permit us to ask more pertinent questions when looking at the law with the aim of putting it to use for the protection of civilians.

The oldest of the international conventions concerning the prohibition of the employment of certain weapons, that is to say deriving from that part of the law of war, sometimes known as the “law of The Hague”, to distinguish it from the “law of Geneva”, will be a hundred years old this month: the Declaration of St. Petersburg of November 29—December 11, 1868.

Max Huber was born on 28 December 1874, barely fifteen years after Solferino and Henry Dunant's action in the Chiesa Maggiore at Castiglione, and only ten years after the first Geneva Convention. Thus he grew up with the Red Cross, with which he was to become intimately associated. At the beginning of our century, he wrote about the role and duties of the Red Cross and the Geneva Committee, and also spoke about them in his lectures on international law at Zurich University. He represented Switzerland at various international conferences, including the 1907 Hague Conference; acted as legal expert to the Federal Government; was a member and later president of the Permanent Court of International Justice. In 1923 he was elected a member, in 1925 Vice-President and in 1928 President of the ICRC, to which he tirelessly devoted himself until 1944. When his successor, Carl J. Burckhardt, took leave of absence, he agreed to resume the presidential duties for a time. In token of gratitude, the ICRC made him honorary president for life.

La República de Bolivia, mediante su declaración del 10 de agosto de 1992, reconoce la competencia de la Comisión International de Encuesta.

De conformidad con el artículo 90, párrafo 2, apartado a), del Protocolo adicional I a los Convenios de Ginebra del 12 de agosto de 1949, la República de Bolivia declara que reeonoce ipso facto y sin acuerdo especial, con relación a cualquier otra Alta Parte Contratante que acepte la misma obligación, la competencia de la Comisión International de Encuesta para proceder a una investigación de las denuncias formuladas por otra Parte.

La República de Bolivia es el trigésimo Estado que hace la declaración relativa a la Comision International de Encuesta.

La Conferencia Diplomática sobre la reafirmación y el desarrollo del derecho internacional humanitario aplicable en los conflictos armados ha reanudado sus trabajos en Ginebra el 21 de abril de 1976, bajo la presidencia del Sr. Pierre Graber, Consejero Federal, Jefe del Departamento Político Federal.

Este tercer período de sesiones es la continuación de los períodos de sesiones primero y segundo, que se celebraron también en Ginebra del 20 de febrero al 29 de marzo de 1974, y del 3 de febrero al 18 de abril de 1975, respectivamente.

Al abrir la 31a sesión plenaria, el Presidente saludó a los delegados de los Estados participantes en la Conferencia. Después de señalar que la mitad de los artículos de los proyectos de Protocolos adicionales a los Convenios de Ginebra de 1949 ya han sido aprobados por las Comisiones, el Sr. Graber precisó que todavía quedan por resolver difíciles problemas, por lo que hizo un llamamiento para que se dé muestras de una voluntad de cooperación semejante a la que animó los trabajos del segundo período de sesiones.

The response of the international community to the massacres and genocide in Rwanda was at times “reluctant” and “inadequate”. This can partly be explained by the amount of human and material resources that would have been required to restore peace and address the more fundamental issues of the failure of the State itself. The Rwandan experience does, however, also raise serious questions about the adequacy of international and regional structures responsible for maintaining and restoring peace.

Questions inevitably arise about the concurrent competence and complementary nature of an international tribunal and national courts, and about cooperation between them. Those questions may well apply to any State on earth because, by virtue of the principle of universal competence, many crimes which international tribunals are competent to try may also be tried by any State irrespective of the place where they are committed or the nationality of the perpetrator.

The dates indicated are those on which the Swiss Federal Department of Foreign Affairs received the official instrument from the State that was ratifying, acceding to or succeeding to the Conventions or Protocols or accepting the competence of the Commission provided for under Article 90 of Protocol I. They thus represent neither the date on which ratification, accession, succession or acceptance of the Commission was decided upon nor that on which the corresponding instrument was sent.

El Principado de Andorra se adhirió, el 17 de septiembre de 1993, a los cuatro Convenios de Ginebra del 12 de agosto de 1949.

Estos instrumentos entrarán en vigor, para el Principado de Andorra, el 17 de marzo de 1994.

El Principado de Andorra es el 184º Estado Parte en los Convenios de Ginebra.

La cuestión de las órdenes superiores es objeto de una abundante literatura. Dada la complejidad del problema, no hay una respuesta sencilla. Según el derecho nacional aplicable, el militar que se niega a ejecutar una orden es pasible de condena penal. Los códigos penales militares prevén en general para los casos graves, especialmente en situación de guerra, que el juez podrá dictar la pena de muerte. Ahora bien, el hecho de haber ejecutado la orden de un superior, que viole el derecho internacional humanitario, no exime, de por sí, la responsabilidad penal del militar subordinado.

Es conveniente, pues, examinar la antinomia de los principios: disciplina-responsabilidad. Examinaremos, en primer lugar, la evolución de ese problema a partir del proceso de Nuremberg.

El Comité de Derecho Internacional de la Cruz Roja Danesa presenta un informe sobre la aplicación del derecho internacional humanitario por Dinamarca en tiempo de paz. En él se examina detenidamente la situación actual y se formulan 23 recomendaciones en pos de posibles mejoras. La finalidad de este informe es propiciar un amplio debate que se espera dé un nuevo impulso para una mejor observancia, por Dinamarca, de las obligaciones dimanantes del derecho internacional humanitario.

El informe consta de cuatro partes. En la primera parte, se hace una reseña histórica del derecho internacional humanitario y un resumen de las medidas de aplicación en seis diferentes Estados: Suecia, Noruega, Bélgica, Países Bajos, Alemania y Estados Unidos. Se examinan, asimismo, cinco ámbitos: enjuiciamiento por crímenes de guerra, definición de «combatiente», protección de la población civil, métodos y medios de hacer la guerra y difusión del derecho internacional humanitario. En la segunda, se abordan el proceso y las medidas concretas de aplicación en Dinamarca. En la tercera parte, figuran las conclusiones y recomendaciones, un resumen en inglés y un glosario. En la cuarta parte, hay varios anexos, que completan el texto de las tres primeras partes.

Los problemas que plantean las minas antipersonal, especialmente en Camboya, Afganistán, Kuwait y Angola, por solo citar los países donde hay esparcidas cantidades considerables de ellas y, además, en regiones en que representan un peligro para la población civil, incluso mucho después de terminadas las hostilidades, nos han llevado a interesarnos más de cerca por este problema.
