While this special issue raises a significant number of questions, constraints have dictated that only some of these questions are actually answered. The pioneering work presented consequently remains a modest attempt to initiate a more general discussion about the causes and the social and economic consequences of business failure in the early modern period, particularly with regard to colonial enterprises.

The Dutch West India Company (WIC), founded in 1621, was, in the words of the States General, “disbanded and destroyed” in September 1674 due to bankruptcy. In its stead, a second West India Company was founded, with a charter largely taken over from the first. This article explores how the dissolution of the first company and the conflicting interests of stockholders, bondholders, and company directors were managed. As it turns out, the old company was not actually liquidated; instead, its assets were simply handed over to the successor company, while an intricate financial construction was devised to take care of the debt burden and to capitalize the new company. The reasons for this unusual arrangement must be sought in the company's great political, and particularly geopolitical, importance. Since the Dutch state was unwilling and unable to handle colonial governance and defence itself, it needed a placeholder in the form of a chartered company. However, the bankruptcy of the WIC, coming at the time it did, had major consequences for the shape of the Dutch Atlantic of the eighteenth century.

A renewed interested in Indian Ocean studies has underlined possibilities of the transnational. This study highlights lexical borrowing as an analytical tool to deepen our understanding of cultural exchanges between Indian Ocean ports during the long nineteenth century, comparing loanwords from several Asian and African languages and demonstrating how doing so can re-establish severed links between communities. In this comparative analysis, four research avenues come to the fore as specifically useful to explore the dynamics of non-elite contact in this part of the world: (1) nautical jargon, (2) textile terms, (3) culinary terms, and (4) slang associated with society’s lower strata. These domains give prominence to a spectrum of cultural brokers frequently overlooked in the wider literature. It is demonstrated through concrete examples that an analysis of lexical borrowing can add depth and substance to existing scholarship on interethnic contact in the Indian Ocean, providing methodological inspiration to examine lesser studied connections. This study reveals no unified linguistic landscape, but several key individual connections between the ports of the Indian Ocean frequented by Persian, Hindustani, and Malay-speaking communities.

VOC officials as well as the Mughal administrators conducted their trading activities in Bengal under different systems of jurisdiction. They both used local brokers and ordinary villagers who became simultaneously part of the VOC and Mughal jurisdictions. But what happened when conflicts broke out between the Company and the Mughal officials? In which jurisdiction did the brokers then participate and why? This article explores such questions through the study of two legal cases involving the VOC in Bengal. It argues that the institutional binary of the VOC and the Mughal as administrative entities were not stable in the face of personal interests and factional ambitions.

Through an institutional approach and by focusing on long-term developments, this article offers a genealogy of the pluralistic character of the landraad (regional colonial court) in colonial Java. It argues that the pluralistic landraden—consisting of a Dutch president, Javanese judges, a local prosecutor, and Islamic and Chinese advisers—were crucial to the process of colonial state formation. This long-term process reflects continuities rather than rupture and change between the era of the VOC and the nineteenth-century developing colonial state. The spatial sites of the landraden reveal not only the conflicts between several layers, institutions, and individuals in the process of colonial state formation but also the importance of local actors in this process. Local dynamics as well as tensions between the various layers of the colonial state, which were striving either for uniformity or for the maintenance of local pluralities, provide insights into the complex formation processes of dual rule from below.

This article takes a single moment—a court case that took place in Zanzibar in 1910—and uses it to explore the legal imaginaries that circulated around the Western Indian Ocean at the height of British imperialism. It stitches together the actions of litigants, the utterances of qadis, and the proclamations of jurists, reading them alongside the silences in the legal material itself to bring to life a world of law, mobility, and imagination. More broadly, it suggests that through the exploration of parallel but never fully intersecting legal encounters in South Arabia and East Africa that emerged from a single moment, historians might use micro-level discourses and actions to make claims about macro-level phenomena.

This article examines the claims of Dutch East India Company (VOC) officials in the mid-eighteenth century regarding the Islamic source of a legal code prepared for the local population in Semarang, northeast Java. Although the VOC had encountered local legal cultures in Indonesia since the mid-seventeenth century, it preferred to circumvent those in favour of European laws whenever possible. But in the eighteenth century, VOC officials addressed indigenous legal systems more directly when the company sought possibilities for direct control. This resulted in the production of many codes on the legal status of Muslim and Chinese subjects of Indonesia. In the process of codification, some officials claimed to have consulted Islamic legal texts and Muslim jurists. One criminal code that came out of the effort supposedly took its rulings accurately from the Mugharrar, which is possibly the Muḥarrar written by the Islamic jurist ʿAbd al-Karīm al-Rāfiʿī (d. 1226). I argue that this assertion is baseless, and demonstrate that the very pretense is part of a larger colonial project that sought legitimacy from the indigenous subjects at a time of political and economic crises.

When judicial department officials at Bombay began to enforce the British East India Company’s (EIC) authority over the production and authentication of certain types of legal documents in the late 1830s, qāẓīs (Islamic judges) like Sayyid Aḥmad Ḥusain of Bharuch, objected to their loss of authority. In petitions sent to the Governor in Council from the edges of empire, these legal intermediaries objected to the Company’s interference with their livelihoods. Although the qazis’ complaints did not yield the desired results, by demonstrating the utility of their record-keeping abilities, qazis were able to retain discrete rights. The effects of these negotiations demonstrate the ways in which the intersections of expanding Company policies and local legal activity contributed to the growth of imperial power. Attending to the particularities of local legal practice, captured in the writings of these qazis, this article highlights the material mechanisms by which the EIC co-opted existing documentary cultures to extend state surveillance over local populations and challenges prevailing histories of legal translation and codification by focusing on the social ramifications of changing legal definitions at the moment such relations were first articulated in writing.
