Humanitarian assistance in armed conflict and other disasters can involve a great variety of institutions and participants all operating simultaneously, including national civil defence organizations, military units, Red Cross and Red Crescent Societies, international governmental organizations and non-governmental organizations (NGOs).

Ha comenzado el cuarto período de sesiones de la Conferencia Diplomática sobre la reafirmación y el desarrollo del derecho international humanitario aplicable en los conflictos armados. Se delibera actualmente sobre los dos Protocolos adicionales a los Convenios de Ginebra de 1949. El primero desarrolla el derecho humanitario aplicable en los conflictos armados internacionales, principalmente, ampliando la protectión a la población civil, aun cuando no esté en poder del enemigo, y extendiendo al personal sanitario civil la protectión reservada hasta ahora, sobre todo, al personal sanitario militar. El segundo desarrolla el derecho aplicable en los conflictos armados sin carácter internacional, limitado, actualmente, a unos pocos principios estipulados en el artículo 3, común a los cuatro Convenios de 1949.

La aparente vigencia plurisecular de las expresiones ius ad bellum/ius in bello, favorecida por los espejismos de la augusta solemnidad del latín, es engañosa. En realidad, no aparecen sino en la época de la Sociedad de las Naciones, y se imponen como tópico en la doctrina y en la práctica sólo después de la Segunda Guerra Mundial, más precisamente en las postrimerías de la década de los 40. A continuatión se explica su advenimiento.

Se celebraron, el año 1978, el CL aniversario del nacimiento de Henry Dunant, el XXX aniversario de la Declaratión Universal de Derechos Humanos y el XXV aniversario del Convenio Europeo de Derechos Humanos; además, entraron en vigor el Convenio Americano de Derechos Humanos de 1969 y los Protocolos adicionales de 1977 a los Convenios de Ginebra. La coincidencia de esos memorables acontecimientos invita a reflexinar sobre las relaciones que hay entre el derecho internacional humanitario y los derechos humanos.

The refugee does not enjoy special protection in IHL except in several provisions which will be considered below, nor is there any particular definition of a refugee as a person protected by IHL. The refugee is above all a civilian person and is protected as such by the relevant provisions of IHL. The sole criterion, for the purposes of the Fourth Geneva Convention, is in fact the absence of protection by any government. The term “refugee” is thus given a broad connotation. In international public law there are two defined categories of refugee, to which a third category is usually added by analogy.

La Société japonaise de la Croix-Rouge a dès avant la guerre été, comme on sait, une des plus puissantes et des mieux organisées. En 1911, elle comptait plus d'un million et demi de membres (soit le 1/35 de la population totale, proportion qui ne se trouvait nulle part ailleurs, sauf erreur); son fonds de réserve atteignait, cette même année 1911, 15 millions de yens, et son assemblée générale réunit 35,000 membres.

Immediately after hostilities broke out between Iraq and Kuwait on 2 August 1990, the ICRC reminded all parties of their obligations under the 1949 Geneva Conventions, of which they are signatories (see IRRC No. 278, September-October 1990, p. 444).

Francisco Suárez, “the prince of modern jurists”, was accused by some of being a great anti-monarchist, even the first regicide, because he was the first “convinced and avowed republican”.

He incorporated Platonist, Aristotelian, Augustinian and Thomist ontology, metaphysics and theodicy within a legal framework; in urisprudence, he introduced the world of ideas into the material world; his discourse on law is valid for his own day and for all time. In dealing with abstract questions, he developed a philosophy of law that is applicable to concrete situations.

La Xme Conférence des Sociétés de la Croix-Rouge, tenue à Genève en mars 1921, dans sa XVme résolution, avait émis le vœu «que les gouvernements concluent dans le plus bref «délai possible une Convention diplomatique sur les prison-«niers de guerre, les déportés, les évacués et les réfugiés, préci-«sant leur situation juridique et fixant les règles du régime «auquel ils pourront être soumis.

On admet généralement que l'éducation en matière de droits de l'homme est peut-être bien l'un des instruments les plus efficaces pour promouvoir le respect de ces droits. Ceux dont la profession implique l'exercice du pouvoir sur d'autres ont manifestement besoin de connaître les limites de leur pouvoir et il se trouve que les membres des forces armées font précisément partie de ce groupe-là. Leurs actes engagent la responsabilité de leur Etat en vertu de traités relatifs aux droits de l'homme, où que ces actes soient commis. C'est la raison pour laquelle une certaine instruction en matière de droits de l'homme, notamment de droits non dérogeables, est nécessaire mais c'est le droit humanitaire qui constitue l'ensemble de règies imposant les interdictions et restrictions les plus importantes à la conduite des forces armées.

The environment in which the ICRC works and communicates is constantly changing. The ICRC is also constantly seeking support that will allow it to gain access to victims, carry out its work, generate the diplomatic and financial backing needed for that work and ensure the safety of its delegates. The primary aim of communication is not merely to pass on messages from the organization effectively. It is just as necessary to understand the issues concerning the various audiences and how they perceive those issues as it is to inform them. The ICRC draws on a wide array of communication strategies and resources, depending on their complementarity and their potential impact, ranging from meetings with local armed groups to the use of mass communication tools. Communication is thus an integral part of the ICRC's decision-making process, both at headquarters and in each context in the field.

The question of the protection of victims of non-international conflicts was one item on the agenda of the XXth International Conference of the Red Cross at Vienna in 1965 which adopted a Resolution, No. XXXI, urging the ICRC to continue its work with the aim of strengthening Red Cross humanitarian, assistance to such victims. The same Resolution recommended governments of States parties to the Geneva Conventions and National Societies to support these efforts in their respective countries.

The idea of “respect for human rights and for fundamental freedoms for all” has been disseminated throughout the world since the Second World War and has influenced both international law and national legislation in many States. Nevertheless, torture, that most fundamental assault on the human person, has continued over the years to be practised, either systematically or occasionally, in many countries. Torture, in which a person is intentionally subjected to extreme physical pain or emotional distress, is used mainly to elicit information, break the will to resist, intimidate, humiliate and degrade. It is also used to mete out (illegal) punishment for real or supposed wrongdoings.2 Techniques of torture include withholding food and preventing sleep, abrupt alternation of extreme cold and heat or silence and noise, total isolation, causing mental confusion and distress through misinformation or other means, the use of brute force- sometimes resulting in permanent mutilation- rape, electric shocks, the application of chemicals and Pharmaceuticals, finally death threats.
