In war, individuals are vulnerable not only physically but also in terms of their cultural identity, and the obliteration of cultural heritage often becomes a central issue. This is particularly the case in armed conflicts with an ethnic, cultural or religious character. In some regions, cultural heritage consists more of monuments and objects; it is a “tangible” heritage, mostly protected by the law of armed conflict. Elsewhere, where structures are impermanent, cultural heritage is mainly expressed through orality, gestures, rituals, music and other forms of expression that individuals create using various media and instruments. Such heritage is mainly “intangible”. This essay aims to show that cultural heritage is both tangible and intangible, and that the law which protects such heritage is not limited to the law of armed conflict. Cultural heritage also benefits from the protection of other applicable instruments, such as human rights treaties and the UNESCO cultural heritage conventions.

The current initiative on the humanitarian consequences of nuclear weapons has offered States the opportunity to reinvigorate the disarmament debate. While Africa has taken this opportunity to engage on nuclear disarmament, the impact of its efforts remains to be seen. The purpose of this article is to recall the value of African engagement, and to identify the important role that South Africa could play in leading the African continent in its call for a world free of nuclear weapons.

The people of the Pacific region have suffered widespread and persisting radioactive contamination, displacement and transgenerational harm from nuclear test explosions. This paper reviews radiation health effects and the global impacts of nuclear testing, as context for the health and environmental consequences of nuclear test explosions in Australia, the Marshall Islands, the central Pacific and French Polynesia. The resulting humanitarian needs include recognition, accountability, monitoring, care, compensation and remediation. Treaty architecture to comprehensively prohibit nuclear weapons and provide for their elimination is considered the most promising way to durably end nuclear testing. Evidence of the humanitarian impacts of nuclear tests, and survivor testimony, can contribute towards fulfilling the humanitarian imperative to eradicate nuclear weapons.

In recent years, there has been more and more interaction and engagement between “faith-based” organizations (FBOs) and secular humanitarian organizations. While humanitarian organizations operate under the humanitarian principles of humanity, neutrality, impartiality and independence, it is often believed that faith-based organizations cannot be neutral or impartial due to their religious identity and agenda. Drawing on the research of Islamic Relief Worldwide, this article looks critically at connections that can be drawn between Islamic religious principles and those upheld as key to secular humanitarian action. The article outlines the Islamic maqasid al-Shari'ah framework as an example of how religious-based approaches can provide a basis for humanitarian action that is both relevant to Islamic communities and complementary to humanitarian principles.

In the post-9/11 era, the label “asymmetric wars” has often been used to question the relevance of certain aspects of international humanitarian law (IHL); to push for redefining the combatant/civilian distinction; and to try to reverse accepted norms such as the bans on torture and assassination. In this piece, we focused on legal and policy discussions in the United States and Israel because they better illustrate the dynamics of State-led “norm entrepreneurship”, or the attempt to propose opposing or modified norms as a revision of IHL. We argue that although these developments are to be taken seriously, they have not weakened the normative power of IHL or made it passé. On the contrary, they have made it more relevant than ever. IHL is not just a complex (and increasingly sophisticated) branch of law detached from reality. Rather, it is the embodiment of widely shared principles of morality and ethics, and stands as a normative “guardian” against processes of moral disengagement that make torture and the acceptance of civilian deaths more palatable.

The participation of nuclear India in the humanitarian impact of nuclear weapons conferences has generated curiosity in the global community. The world is bewildered to know that India simultaneously possesses nuclear weapons and participates in the humanitarian impact initiative. Even observers of the humanitarian impact movement often wonder what contribution India makes to the movement. Some historical insight into India's nuclear policy solves the puzzle. The humanitarian impact aspect of the nuclear debate has been an ingredient in India's policy because of India's strategic culture. The components of the Humanitarian Pledge are echoed in India's nuclear policy, and India maintains that a world without nuclear weapons will be more secure.

This article documents the work of Islamic charities and NGOs from diverse backgrounds to develop sets of principles guiding their humanitarian and charitable work, in the framework of the dialogue and cooperation among Islamic NGOs and charities as well as between Islamic and Western humanitarian agencies. The authors look at draft documents that resulted from these processes, and the way these relate to the core principles of humanitarian action. They further follow how the dialogue and cooperation between humanitarian organizations from different backgrounds and origins has influenced the orientation of this debate on humanitarian principles from theory and identity to concrete and shared challenges and concerns.

States party to the European Convention for the Protection of Human Rights and Fundamental Freedoms that engage in military operations abroad face an increased risk to be held responsible for violations of the Convention, given the relatively recent case law adopted by the European Court of Human Rights. This article examines some of the issues raised by the concurrent applicability of international humanitarian law and European human rights law. It also seeks to identify ways to reconcile these two different, but not incompatible, branches of international law.

This case study of a network of evangelical churches in Lebanon, based on data collected during an evaluation in 2014, presents a critique of common understandings about the humanitarian principle of impartiality, and questions assumptions about the compatibility between religious fervour and humanitarian values. Churches attempting to respect impartiality while implementing a food aid project for Syrian refugees have sought to mitigate potential problems through relationship-building and promotion of human dignity in order to ensure needs-responsiveness. Though many Lebanese Evangelical Christians do continue to engage in evangelistic activity, they benefit from strong community ties and demonstrate a high level of sensitivity to their beneficiaries' urgent needs as well as their sense of dignity.

This article identifies five factors that will shape the legal implications of the use of autonomous military systems. It contends that the systems which present legal challenges are those programmed to “make decisions” that are regulated by law. In so doing, they transfer control of, and responsibility for, those decisions away from those who have been traditionally seen as decision-makers to persons responsible for developing and deploying the system. The article also suggests that there may be limits to the extent to which the rules of international humanitarian law can appropriately regulate the altered relationship between soldiers and their increasingly autonomous weapon systems.

This paper discusses non-State actors’ motivation and capacity to develop and use chemical, biological, radiological or nuclear (CBRN) improvised weapons in attacks, as well as the possible consequences of such use. Six types of groups have been identified as potential CBRN weapons users that may increasingly be able to acquire relevant CBRN weapons-related knowledge, skills and possibly materials. As technical barriers still form a gap between the theoretical possibility and the operational reality, any potential future CBRN attacks would most likely be crude, low-level attacks, including chemical or radiological materials. CBRN attacks carried out by non-State actors in the future are likely to be more disruptive than destructive.

In this Opinion Note, Mohd Hisham Mohd Kamal examines neutral humanitarian action during armed conflicts from an Islamic perspective. By analyzing the Qur'an and the Sunnah, he finds that it is permissible to recognize a neutral third party. Moreover, Mohd Hisham Mohd Kamal considers siyasah al-Shar'iyyah and maqasid al-Shari'ah and finds that neutrality leads to the protection of lives and dignity and is thus compatible with the two concepts. He concludes that neutrality is permissible from the Islamic perspective.

To what extent do the ways in which we anticipate threats, analyze their possible consequences and determine ways to mitigate them explain the causes of warfare in the future? This article – though never attempting to predict – poses plausible causes of future wars that may stem from transformative change over the next two decades. In asking the question “Are we ready?” to deal with such wars, the answer is framed in terms of the interrelationship between the prospect of profound change, emerging tensions, unprecedented violence and organizational capacities to deal with complexity and uncertainty. To be prepared to deal with the prospect of future wars, relevant organizations have to be more anticipatory and adaptive, while at the same time looking for new ways to engage the wider international community. The article concludes with a set of recommendations intended to meet such organizational challenges – with the aspiration that the question “Are we ready?” can be answered more affirmatively in the future.

In recent weeks and months, the issues of nuclear disarmament and nuclear non-proliferation have assumed a new urgency on the world stage. Energetic diplomatic efforts are heralding long overdue progress on nuclear weapons issues in the post-Cold War era.

The following speech was given by the President of the International Committee of the Red Cross, Peter Maurer, on 2 October 2014 at the Maison de la Paix in Geneva during a conference organized by the Graduate Institute of International and Development Studies. Maurer recalled the continued relevance and importance of the humanitarian principles and warned that a lack of common understanding, as well as politicized uses of the principles, jeopardizes the scope and scale of humanitarian action. The speech launched the ICRC's Second Research and Debate Cycle on Principles Guiding Humanitarian Action. Throughout 2015 – the year of the 50th anniversary of the adoption of the Fundamental Principles of the Red Cross and Red Movement (the Movement) and of the 32nd International Conference of the Movement, and leading to the World Humanitarian Summit in 2016 – the Research and Debate Cycyle has gathered key actors in the humanitarian field during public events and high-level conferences.1 These events have encouraged substantive discussions on the principles among experts from the Movement, the humanitarian, governmental and academic fields, and other informed participants.

This year is the 70th anniversary of the atomic bombings of Hiroshima and Nagasaki – events that have left an indelible mark on humanity's conscience and consciousness.
