Drawing on ethnographic data gathered in lower criminal courts and in one unit of the Public Prosecutor's Office in Santiago, Chile, I explore the way in which criminal offenses considered flagrant are treated by the Chilean criminal justice system. Citing the literature on legal technicalities, I describe how flagrant criminal offenses are constructed through practices that make it possible for the actors involved to avoid directly referring to the alleged facts. From their identification on the streets by police officers to their reassignment to a different unit of the Public Prosecutor's Office or their adjudication at a criminal court, flagrant criminal offenses are defined by a specific way of approaching the alleged facts, which is translated into specific organizational and documentary practices. The role of these practices contrasts with the apparently marginal role that the detention in flagrante delicto plays in the mechanics of criminal law. As a technicality, the flagrant character of a criminal offense conveys certain epistemological assumptions about how to determine what happened and what exactly constitutes the criminal offense. More specifically, it conveys assumptions about what cannot, for the moment, be known and that can, therefore, be ignored throughout the bureaucratic and judicial process.

In recent years, there has been an unprecedented rise in the number of immigrants facing removal from the United States, many of whom make a case for their right to be granted relief from removal and stay in the country. While immigrant men of color are disproportionately represented in both removal proceedings and contemporary sociopolitical constructions of immigrant criminalization, existing literature has largely overlooked the state's cultural logics involved in decision-making about immigrant relief or removal. Drawing on theories of racialized masculinity and state gendering, I analyze how judges in immigration court utilize a politicized discourse of masculinity to justify legalization for immigrant men through their relational ties to US citizens. Using ethnographic observations of hearings for the Cancellation of Removal and the judicial decisions that support immigrant removal or relief, I develop a conceptual framework of “relational masculinity,” in which judges evaluate men as emotionally involved parents and partners in traditional family arrangements, raising culturally integrated Americans, and as economic providers of upward social mobility, to determine their deservingness for relief. These findings suggest that, alongside widespread gendered and racialized criminalization, the state also engages in an evaluation process to assess the masculinity of immigrant men who may be formally admitted into the United States. I argue that adherence to these gendered and racialized norms plays a key role in determining migrants' deservingness and membership, with important implications for how the state actively manages immigrant masculinity and bolsters caregiving support for US citizens, alongside heightened criminalization.

Lower state courts are the focus of both international and national access to justice policies and programs but remain understudied in Uganda. Drawing on 3 years of ethnographically informed research on citizen engagement with a busy magistrates' court in post-war northern Uganda, we show the diverse reasons why citizens appeal to the rule-of-law in places where state authority is contested. In a context of limited statehood, against a backdrop of high-levels of corruption and inefficiency in the judicial system, people turn to lower state courts for normative, pragmatic, and tactical reasons that are not well captured by conventional measures of procedural justice. Our findings extend theory on citizen-authority relations in a global context, shedding light on contextual meanings of legitimacy, trust, and corruption in places where lower state courts are deeply problematic sites for achieving justice.

Starting in 2014, Brazilian politics was shaken up by the lava jato (LJ) operation, a law-centered anticorruption initiative. LJ unveiled a large corruption scheme in Brazil's national oil company Petrobras, which involved Petrobras directors, political party officials, and large construction companies. LJ was both disruptive and contentious. To some, it started a new chapter in Brazilian history, marked by greater respect for the “rule of law” and a collective “state of mind” concerned with “ending impunity” and building integrity in politics and businesses. To others, it contributed to undermining democracy and the rule of law, paving the way for an autocratic leader—the current Brazilian president Jair Bolsonaro. This article sheds further light on those discussions by looking at LJ as a site of “legal consciousness” production. Empirically, the article focuses on conversations generated by lead LJ prosecutors on a major social media platform (Facebook) from 2017 to 2019. Considering this body of data, the article addresses the question: “When prosecutors and ‘the people’ talked about LJ, what did they talk about?” My findings support the more skeptical views of the operation. The exchanges between LJ prosecutors and their Facebook followers supported the co-production of a cultural schema averse to the “rule of law.” These findings have implications for both legal consciousness and anticorruption research.

In settler colonial states such as Canada, tax is central to political ideas that circulate about Indigenous nations and people. The stories that are told about Indigenous peoples by ‘taxpayers’ often involve complaints about budgets, welfare, and ‘unfair’ tax arrangements. The paper theorizes how informal ‘tax imaginaries’ and ‘taxpayer’ subjectivities are forged through state policy and how ostensibly fiscal concerns are imbricated with white political entitlement that erodes Indigenous legal and political sovereignty. By tracing the construction of taxpayer concerns and tax myths as forms of fiscalized racism, the paper demonstrates the importance of tax to settler colonialism and the shape of Indigenous-settler relations. Taxpayer subjects are not just legal or material positionings in relation to tax and the state, but powerful subjects that refigure political problems as ‘fiscal’ and construct Indigenous people and nations through racialized repertoires of property and possession.

How does a potential juror's association with the criminal legal system matter during jury selection? Growing scholarship examines statutory exclusions of people with felony convictions, sometimes characterizing felon-juror exclusion as a collateral consequence of mass incarceration. Less research has considered whether court officials seek to exclude potential jurors based on lower-level forms of contact or perceived association. We draw on interviews with 103 lawyers and judges in a Northeastern state to examine how court officials think about juror bias in relation to criminal legal association beyond felon status. We find that court officials often seek to remove people perceived to be offenders with lower-level forms of system association as well as people perceived to be crime victims. These exclusionary efforts extend to also exclude perceived offenders' and victims' social networks. These practices are racialized and gendered, likely contributing to the systematic exclusion of marginalized racial/ethnic groups and women. This article expands the collateral consequences literature in two ways: first, by revealing how collateral consequences can be conceptualized not just in relation to people criminalized by the law but also in relation to those whom the law constructs as victims; and second, by underscoring how collateral consequences feed back into the system to reproduce its unequal administration.

While federal anti-employment discrimination laws have helped diminish inequality at work, discrimination persists, in part perhaps due to unequal handling of equal employment lawsuits. Prior research demonstrates that the definition of discrimination can vary based on local normative ideas, while another line shows that a judge's race or gender can shape how related lawsuits are handled. In this article, I draw on a set of EEOC workplace discrimination cases prosecuted in Federal Court and combine it with locality data, to analyze: (1) the impact of local context, specifically rurality, local political context, and southerness and; (2) how judges' race and gender interact with the local cultural-milieu. Findings reveal that plaintiffs of colour in race discrimination cases fair worse in rural courts or before white judges. Meanwhile, white judges in conservative areas are more defendant friendly than those outside the in more liberal areas. Black judges, in comparison, are more plaintiff friendly in conservative areas when compared to black judges in more liberal areas. While female judges are generally more plaintiff friendly than male judges in sex cases, location has no discernible effect.

This study examines whether there is popular support for a restrictive immigration policy aimed at denying safe haven to human rights abusers and those affiliated with terrorism. We designed a public opinion survey experiment that asks respondents to evaluate whether low level or high-level Taliban members who otherwise qualify for refugee status deserve immigration benefits. We found that a majority of respondents did not immediately deny a visa to low-level worker. Looking at respondents' explanations for their decision, we find two distinct clusters of reasons that we classify as either circumstantial–focused on the particularities of the case–or categorical–focused on general attributes of the applicant. We suggest that domestic and international criminal law logics about acts and intentions, as well as roles and responsibilities, are reflected in beliefs about deservingness in this distinct immigration context, and may support more generous attitudes toward those seeking refugee status. Many respondents using circumstantial reasoning saw a distinction between the jobs potential immigrants have done in their pasts and what they actually believe, underscoring the fraught dynamics of armed conflict in which people may be swept up in violence they do not support.

The Lactation at Work Law amended the Fair Labor Standards Act to mandate employer accommodation of employees' breast milk expression. Interviews with employees, human resource specialists, and supervising managers in nine industries found that some organizations' supervising managers, who initially perceived accommodations only as a legal mandate furthering managerial goals, over time changed to understanding lactation accommodations through a children's-health lens that created morality-driven motivations for legal compliance–a “moralization of the law.” Educational discussions with lactating employees not only provided these supervising managers with insights into lactation at work, but also sensitized them to ethical issues surrounding lactation accommodations.

Different from “judicial repression,” stability justice targets ordinary individuals under the guise of formal judicial procedures, to maintain both social stability and governance legitimacy. Drawing on published judgments and the authors' interviews with judges and prosecutors in China, we find that, in conjunction with the gradual abandonment of traditional violent repression strategies, stability justice has been employed as an alternative tool for managing petitioning activities at the local level. Through the covertly biased application of legal rules and procedural norms, petitioners accused of threatening social stability receive longer terms of pre-trial detention, higher rates of detention before politically sensitive periods, longer custodial sentences, and fewer opportunities for probation. Our findings add new fuel to studies on comparative judicial politics and shed light on judicial behavior in contemporary China.

Mitigating evidence in capital trials provides reasons for a life, rather than death, sentence. Research suggests that mitigation challenges jurors. We contribute to this area by analyzing federal verdict forms in capital cases, which allow jurors to write in their own mitigating factors, providing a direct, rare window onto their mitigation considerations. We use 205 forms from 171 juries to examine the frequency and content of these “write-ins,” using a sentencing theory typically applied to judges, Focal Concerns Theory. We find that four of every 10 juries prompted to offer their own mitigation do so, producing 149 unique write-ins, the majority of which introduces mitigation topics that differ from those listed on the verdict form. Surprisingly, jurors are less likely to offer write-in mitigators in cases involving White defendants than others, even after controlling for support for other mitigating factors and for aggravating factors, which also predict write-ins. Jurors' write-ins reflect a traditional sentencing concern for blameworthiness, and consistent with Focal Concerns Theory, attention to the practical consequences of punishment. Jurors also offered concerns we term “procedural fairness.” Results indicate that juries' views are patterned in ways that are similar, but not identical, to judges' sentencing concerns.

States have begun to pass legislation to provide automatic relief for eligible criminal records, potentially reducing the lifelong collateral consequences of criminal justice involvement. Yet numerous historical examples suggest that racially neutral policies can have profoundly disparate effects across racial groups. In the case of criminal record relief, racial equity in eligibility for a clean slate has not yet been examined. We find that in California, one in five people with convictions met criteria for full conviction relief under the state's automatic relief laws. Yet the share of Black Americans eligible for relief was lower than White Americans, reproducing racial disparities in criminal records. We identify two policy amendments that would reduce the share of Black men in California with convictions on their criminal records from 22% to 9%, thereby narrowing the difference compared to White men from 15 to seven percentage points. Put another way, an additional one in seven Black men currently has a conviction record, compared to their White counterparts. This would decline to an additional one in 14 if both hypothetical policy amendments were incorporated. We close with discussion of criminal history data quality limitations, which pose a second key challenge to equitable implementation of automatic criminal record relief reforms nationwide.

One in seven people in prison in the US is serving a life sentence, and most of these “lifers” will someday be eligible for discretionary parole. But little is known about a key aspect of parole decision-making: remorse assessments. Because remorse is a complex emotion that arises from past wrongdoing and unfolds over time, assessing the sincerity of another person's remorse is neither a simple task of lie detection, nor of determining emotional authenticity. Instead, remorse involves numerous elements, including the relationship between a person's past and present motivations, beliefs, and affective states. To understand how parole board members make sense of remorse, we draw on in-depth interviews with parole commissioners in California, the state with the largest proportion of parole-eligible lifers. We find that commissioners' remorse assessments hinge on their perceptions of lifers' relationships to law and carceral logic. In this way, relational legal consciousness—specifically, second-order legal consciousness—functions as a stand-in for the impossible task of knowing another person's heart or mind. We distinguish relational from second-order legal consciousness and argue that understanding how they operate at parole hearings reveals the larger import of relational legal consciousness as a mechanism via which existing power relations are produced and reproduced, bridging the legal consciousness and law and emotion literatures.

Jury service is a positive, even transformative, experience for many jurors. Prior research establishes that jurors who deliberate on a court case develop more positive views of courts in the relatively short time of jury service, but we know little about the reasons underlying why these positive changes develop. This research focuses on changes in jurors' views after serving on criminal cases because jury service is one of the few opportunities community members have to participate directly in the criminal justice system, with jurors acting as the conscience of the community regarding the extent of prosecutorial power. Unlike most work using actual jurors, this research utilizes surveys with jurors both before and after jury service to understand how jury service brings about increased trust in courts. We examine the influence of three categories of potential factors, deliberating on a case, juror satisfaction, and jurors' attitudes relating to law and justice, finding all three categories work together to significantly predict whether jurors' trust in courts increases, decreases, or stays the same. Policy suggestions include developing innovative ways to capitalize on the positive and overall legitimizing aspects of jury service in criminal cases by increasing community members' meaningful involvement in the courts.

The article analyzes Israel's ecclesiastical court system through the prism of Weberian theory to both empirical and theoretical ends. On the empirical level, it aims to illuminate a grossly understudied socio-legal arena—the communal Christian courts in the Middle-East. On the theoretical level, it seeks to reclaim the Weberian concept of kadijustiz, which refers to “formally irrational” legal systems. In recent decades, scholars have engaged in a process of “blaming” that discredited the conceptualization of Islamic law as kadijustiz and resulted in the concept's erasure from socio-legal theory. After renaming it to the more neutral and non-Orientalist richterjustiz, we employ this new-old concept to analyze Israel's ecclesiastical courts and demonstrate its theoretical and analytical merits. The article concludes with several theoretical propositions, which draw on the empirical case study and contribute to the refinement of Weberian theory.

How and to what extent do defense actors use publicity in trials of protesters in contemporary Russia? Why do they fight over strategic uses of publicity if “everything is decided in advance”? Drawing on original ethnographic research, this article finds, first, that publicity accompanies legal resistance to politicized prosecutions and is inventively used by the defense. Second, mobilization of publicity creates opportunities for the defense to bargain with and keep the prosecution in check. Third, the relationship between publicity and legal resistance in repressive settings is ambiguous. Some human rights lawyers embrace publicity and others avoid it. I argue that this divergence should be interpreted in relation to lawyers' embeddedness in different professional ecologies. At the same time, lawyers' publicity strategies are altered by the interactional dimension of the trial. The latter manifests itself on two levels: at the micro-level of a courtroom and in the public sphere where different publics engage in debates that interfere with lawyers' defense strategies. This paper has broader implications for the analysis of defensive legal mobilization in dual legal systems beyond the Russian case.

This article discusses how administrative practices shape immigration detention policies, addressing both administrative discretion in detention orders and their judicial supervision. Due to vaguely formulated legal criteria and ineffective ex-post judicial supervision, the authorities have considerable discretionary powers in ordering detentions for noncompliant and criminalized noncitizens. Instead of being a measure of last resort, immigration detention is used in a routine manner, with little individual assessment, for the enforcement of removals and the prevention of irregular migration, as well as extensively for crime prevention. The findings demonstrate the role of the police as the main actor in the detention system in Finland, with significant implications for the formation of detention policies.

The legal profession claims a duty of public service that calls on lawyers to volunteer their time through “pro bono” work (i.e., free legal service). And increasingly law firms strongly endorse pro bono and even remunerate time that is provided to clients without charge. But what happens when pro bono is mandated by the law firm, even compensated? Is altruism undermined? Drawing on a survey of 845 lawyers, we develop an integrated theoretical model to account for how volunteering takes place in the course of legal work. The analysis reveals psychological traits, collective norms, economic exchanges, and organizational dimensions shape lawyers' pro bono work in intriguing ways with marked distinctions emerging when pro bono is remunerated by firms. Collective norms known to foster altruistic behavior appear most relevant to pro bono that is outside the job (i.e., unpaid), while organizational supports and constraints as well as economic exchange factors appear most salient to pro bono that is compensated within firms. We argue that a theory of pro bono work requires a more refined understanding of the forces promoting helping behaviors across several dimensions: whether to help, how much to help, and with or without compensation.

The ways in which grievance procedures are used and perceived by incarcerated people raise important questions about the operation of procedural justice and legal consciousness and mobilization scholarship in settings where rights are especially vulnerable. This paper analyzes perceptions and usage of the grievance procedure for incarcerated people using survey data from people (N = 508) in three prisons in Ireland. We find that incarcerated people's views of the grievance procedures are generally negative, though some use it, especially those serving long sentences and those in segregation, with education level not significant in terms of usage. Additionally, having confidence in staff is associated with satisfaction with the procedure, as is the perception that one's rights are respected, showing important connections between perceptions of complaints and aspects of legal consciousness. We suggest a need for further situated analyses of procedural justice and legal consciousness, as well as practical requirements for complaints systems to elicit confidence among incarcerated people.
