International humanitarian law and human rights law share a common goal, namely to protect the individual and to ensure respect for human dignity. Yet these two branches of international public law each have their own characteristics and origins and have evolved in different ways.

Nevertheless, the troubled aftermath of the Second World War, the unchecked rise of violence and poverty in recent decades and the resulting need for improved protection of the ever-growing number of victims of violations of fundamental human rights have all contributed not only to the evolution of the two branches of law but also to their convergence, like “two poor crutches on which disarmed victims can lean simultaneously”, to quote an expressive image by Karel Vasak. This expert went so far as to estimate in 1984 that “the convergence of the two branches has led to an overlapping both on paper and, increasingly, in practice as well”.

En la XXV Conferencia Internacional de la Cruz Roja (Ginebra, 23–31 de octubre de 1986), el CICR presentó un informe sobre la identificación de los medios de transporte sanitarios, incluido el cumplimiento dado a la resolución VIII de la XXIV Conferencia. En ese documento se ponía de relieve que, en un conflicto naval, la protección de los transportes sanitarios marítimos depende en gran medida de los medios técnicos disponibles en el ámbito de la identificación.

La XXV Conferencia reconoció la necesidad de esforzarse continuamente por adaptar los medios de identificación y de señialización del personal, de las unidades y de los medios de transporte sanitarios al desarrollo técnico y aprobó la resolution III: «Identification de los medios de transporte sanitarios»

Rara vez los debates originados por lo que algunos califican de derecho o de deber de injerencia, vinculándolo posteriormente al concepto de derecho de asistencia, han dado a las cuestiones humanitarias tal publicidad. A diferentes niveles de comprensión, el público en general, los medios de comunicación y los juristas especializados se han apasionado por esta cuestión; incluso han llegado a encararse.

En el fondo no es una mala cosa, porque estas pasiones no dejan indiferentes a los Gobiernos y así se puede avanzar en el ámbito humanitario. De hecho, es indiscutible que se han planteado, y aún se plantean, importantes cuestiones.

Con profunda tristeza, el CICR se enteró del fallecimiento, el 5 de noviembre de 1991, a la edad de 80 años, del profesor Stanislaw E. Nahlik.

Los miembros del Comité Internacional y muchos de sus colaboradores que lo conocían bien deploran la desaparición de un gran humanista de nuestro tiempo, que dedicó su vida a la defensa y a la promoción del derecho.

Nacido el 8 de mayo de 1911 en Lvov (Polonia), Stanislaw Nahlik hizo sus estudios en la Universidad Johann-Casimir de Lvov, donde obtuvo, en 1933, licenciaturas en Derecho y en Ciencias Políticas. En 1936, entró en el servicio diplomático de la República de Polonia y sucesivamente, trabajó en el Consulado General de Polonia en Londres y, de 1939 a 1946, en la Embajada de Polonia en Berna.

The International Criminal Tribunal for the former Yugoslavia (“the International Tribunal”) was established over four years ago in response to the mass killings, widespread and systematic rape and “ethnic cleansing” being practised in the former Yugoslavia on a scale and of a ferocity not seen on the European continent since the end of the Second World War. The United Nations Security Council considered that this situation constituted a threat to international peace and security. It therefore established the International Tribunal as a subsidiary judicial organ, in the belief that this would help halt and redress such violations.

La cuestión de la aplicación es el mayor reto hoy para el derecho internacional humanitario. A pesar de que todas las ramas del derecho internacional tropiezan con el problema de llevar a la acción las obligaciones jurídicas de los Estados, hay un gran contraste entre las muy desarrolladas normas del derecho humanitario, muchas de las cuales tienen una aceptacion casi universal, y las repetidas violaciones de esas normas en los conflictos que tienen lugar en el mundo.

A pesar de los diversos mecanismos establecidos para promover el respeto del derecho humanitario, incumbe principalmente a los Estados la responsabilidad de aplicar sus normas. De conformidad con los Convenios de Ginebra de 1949 y de sus Protocolos adicionales de 1977, los Estados tienen la clara obligación de hacer que se respete y se aplique el derecho humanitario, asi como de aprobar con esta fmalidad un conjunto de medidas legislativas y administrativas a nivel nacional.

In response to an invitation, the President of the Red Cross of the Provisional Revolutionary Government of the Republic of South Vietnam paid a visit to the ICRC on 19 March. He was received by Mr. Roger Gallopin, President of the Executive Board, and Mr. Jean-Pierre Hocké, Director of the Department of Operations. Afterwards, he visited the League of Red Cross Societies where he was welcomed by Mr. Henrik Beer, Secretary General.

Work carried out during the past year is described in the usual ICRC report.

The 1968 Annual Report is divided as previously into two parts: practical, and general and permanent activities. The former deals with various countries and continents. Emphasis is laid on efforts made for victims in the Nigerian conflict and relief data showed their increasing extent. On the other hand, some of the specialist services, such as the Central Tracing Agency in Geneva, the International Tracing Service at Arolsen, the Medical Personnel and War Disablement Sections have continued to be particularly active. One has only to quote the Central Agency which in 1968 received 54,783 communications and sent out 54,227 items, a considerable increase in volume in comparison with the previous year.

Toute réflexion sur la sécurité doit avoir comme but de préserver la neutralité, l'indépendance et l'impartialité de l'action humanitaire, condition sine qua non de l'aptitude du CICR à protéger et aider les victimes de conflit. Toute intervention humanitaire qui galvaude ces principes fondamentaux rencontre tôt ou tard la méfiance des populations à aider ou est condamnée à la paralysie.

Les Journées d'aviation sanitaire coloniale, organisées par les Amis de l'aviation sanitaire, ont été inaugurées, le 25 juillet 1931, sous la présidence de M. le gouverneur général Ollivier, assisté de M. Laurent-Eynac, ancien ministre de l'Air, de M. le médecin général inspecteur Lasnet, représentant le ministre des Colonies, et président d'honneur des Journées, de M. l'Inspecteur général Fortant, représentant le ministre de l'Air, de M. le médecin général inspecteur Dopter, directeur du Service de santé au ministère de la Guerre, représentant le ministre de la Guerre et président d'honneur des Journées, de M. le docteur Chassaing, sénateur, président des Amis de l'aviation sanitaire, de M. le docteur Foveau de Courmelles, de Mlle Marvingt et de M. Julliot, tous trois vice-présidents des Amis de l'Aviation sanitaire, de M. Némirovsky, commissaire général des Journées, de M. le médecin commandant Mouchard, commissaire scientifique, et de M. Charlet, commissaire scientifique adjoint des Journées, de MM. les délégues des gouvernements étrangers, de M. le médecin général inspecteur Rigollet, de M. le médecin général Rouvillois, de M. le colonel Orthlieb, directeur de l'aviation au Levant, de M. le médecin colonel Epaulard, sous-directeur du Service de santé au Maroe, de M. Homo, chef de cabinet du maréchal Lyautey, de M. Du Vivier de Sreel, directeur des congrès, et de M. Letzgus, secrétaire général des congrès.

Le problème juridique international soulevé par l'aviation sanitaire en temps de guerre date de 1912; il est né au sein de l'ancienne Ligue nationale aérienne, le 21 novembre 1912, date à laquelle le Comité de contentieux de cette ligue, saisi de ce problème par mes soins, a bien voulu, à ma demande, émettre un vœu tendant à ce que le Gouvernement français prît l'initiative de convoquer une conférence internationale de Croix-Rouge aériénne.
