This article first considers how to explain the applicability of international humanitarian law to NATO's armed intervention in the Federal Republic of Yugoslavia during the Kosovo crisis. Despite the fact that NATO, as a regional governmental organization, is not a party to the various treaties of humanitarian law, the individual States participating in the campaign were bound to respect international humanitarian law in its entirety. In the author's opinion the United States, though not party to the 1977 Additional Protocol I, has unilaterally agreed to respect the content of these new rules on the conduct of military operations — it has incorporated many of them in its own military regulations - and was therefore bound to abide by them. In this context, the author also discusses the latest developments with regard to the applicability of international humanitarian law to forces acting under UN authority. The article finally examines the way the international rules affecting the conduct of military operations were respected by the intervening forces, with particular emphasis on the well publicized failures.

Dos mil años antes de que Grocio, Rachel o Ayala hicieran un Uamamiento en Europa en favor del humanitarismo, los antiguos indios tenían ya un conjunto de normas para regir las relaciones entre los Estados del subcontinente en caso de conflicto armado. Según el profesor A. L. Basham:

… en ninguna otra parte del antiguo mundo hubo relaciones tan justas y humanas entre los hombres y entre el hombre y el Estado… Ningún otro legislador de la antigüedad proclamó esos nobles ideales de conducción justa de la batalla como lo hizo Manú. En toda su historia de guerra la India hindú tiene pocos casos de habitantes de una ciudad pasados a cuchillo o de matanza de no combatientes. El horrible sadismo de los reyes de Asiria, que desollaban vivos a sus prisioneros no tiene paralelo alguno en la antigua India. No hay duda de que tuvieron lugar esporádicos ados de crueldad y de opresión; pero, en comparación con la situación en otras culturas, eran leves. A nuestro parecer, la característica más notable de la antigua civilización india es su humanidad.

A mission of the International Committee of the Red Cross, the eighth since 1955, went to Algeria from January 25 to February 23, 1961, in order to visit the principal centres and prisons in which arrested persons had been detained as a result of the events. This mission, which consisted of Mr. Pierre Gaillard, Mr. Roger Vust and Dr. J. L. de Chastonay, visited 61. places of detention of various categories, as well as hospitals in which there were prisoners and detainees. During the course of these visits, relief supplies were handed over to persons under detention. Wherever they went the delegates of the ICRC were able to talk without witnesses and at length with detainees whom they themselves had selected or with those who had expressed the wish to speak with them.

En DIH, el refugiado no es objeto de una protección especial, excepto en algunas disposiciones que examinaremos más adelante. No hay tampoco una definición específica del refugiado como persona protegida por el DIH. El refugiado es, ante todo, una persona civil protegida, como tal, por el DIH, según la normativa estipulada en el DIH para la protección de las personas civiles. El IV Convenio de Ginebra se limita, en efecto, a establecer el criterio de la ausencia de protección por parte de algún Gobierno. El término «refugiado» se emplea, pues, en sentido lato. En derecho internacional público, se definen dos categorías de refugiados, a las que conviene agregar una tercera, generalmente asimilada a ellas. Esas tres categorías son:

Se trata de refugiados en el sentido de la Convención de las Naciones Unidas sobre el Estatuto de los Refugiados del 28 de julio de 1951, de su Protocolo del 31 de enero de 1967 y del Estatuto del Alto Comisionado de las Naciones Unidas para los Refugiados (ACNUR).

En octobre et en novembre 1979, un grand nombre de Khmers quittèrent leurs villages et trouvèrent refuge dans des camps situés en Thaïlande ou le long de la frontière khméro-thaïlandaise. Le CICR et d'autres organismes humanitaires, internationaux ou privés, durent faire face aux besoins d'une nombreuse population soudainement déplacée, épuisée par la famine, la souffrance, la peur, la maladie et la guerre. Dans une telle situation, la première nécessité est d'assurer l'hygiène et de fournir la nourriture, l'eau et les abris, toutes choses indispensables à la survie. Il faut aussi lutter contre la maladie et la mort.

Le VIIe Congrès international de médecine et de pharmacie militaires s'est réuni du 29 mai au 5 juin 1933 à Madrid.

La séance inaugurale, à laquelle assistaient les délégués officiels d'environ 30 différentes nations, eut lieu l'aprèsmidi du 29 mai au Théâtre de la Comédie et fut honorée par la présence de S. Exe. le président de la République, qui était accompagné par le président du Conseil et ministre de la guerre M. Manuel Azana, le ministre de la marine M. José Giral, le président du Congrès, M. le général Gonzalez Granda, médecin-chef de l'armée espagnole.

Lors de la XIIIe Conféence internationale, le Juge Payne m'avait prié de prendre part aux délibérations du Conseil des Gouverneurs. Depuis, j'ai eu l'honneur de siéger à la Haye, à Bruxelles et à Paris dans votre Conseil, sous la magistrale présidence de celui dont nous tous ressentons la perte avec une profonde tristesse.

En février 1950, un grand hebdomadaire illustré français, « Radar », consacrait une page entière à la diffusion des nouvelles Conventions humanitaires signées à Genève en 1949. Cette page comprenait en particulier quelques dessins illustrant le sens de ces quatre Conventions. A propos de la IVe, celle qui concerne la protection des personnes civiles en temps de guerre, un dessin supplémentaire intitulé « Son application ? » représentait un homme lisant son journal en toute quiétude dans une petite maison dont le toit est formé par le texte de la Convention, alors qu'une grosse bombe tombe sur cette maison et va complètement l'anéantir.

No human institution is perfect and the International Committee of the Red Cross is no exception. The criticism most frequently levelled at this venerable body is its silence concerning some of its activities. How can it have a claim to eminence, how can it call powerful governments to account, without seeking the support of men of goodwill through divulgence of full information to the public?

Every war brings its share of missing persons, whether military or civilian. And every individual reported missing is then sought by a family anxiously awaiting news of their loved one. These families cannot be left in such a state of anguish. For the truth, however painful it may be, is preferable to the torture of uncertainty and false hope. In Bosnia and Herzegovina civilians were especially affected by a conflict in which belligerents pursued a policy of ethnic cleansing by expelling minority groups from certain regions. Thousands of people who disappeared in combat or were thrown into prison, summarily executed or massacred, are still being sought by their families.

It is an honour and a privilege for me to address this Conference devoted to a topic of great importance to the International Committee of the Red Cross (ICRC). As a humanitarian organization, whose mandate it is to provide protection and assistance for victims of armed conflicts and which is operational worldwide, the ICRC has been directly concerned with many peace-keeping missions undertaken by the United Nations.
